Finally, as regards the claim that Capricorn did not provide a fully financed offer because it failed to pay the second instalment of the purchase price, and that there may be further aid to Capricorn because, subsequently to the above, the financing conditions for the acquisition of the Nürburgring assets were changed to the benefit of Capricorn, the German authorities argue: (a) there was no benefit for Capricorn, since the second instalment was rescheduled with interest of 8 % and pledges (see footnote 72); (b) there is no State aid involved in the second payment's rescheduling since the decision for the latter is not imputable to the State, because the second payment's rescheduling was decided solely by the insolvency administrator, without the involvement of the Land; and (c) there was no deviation from the rules set by the sellers and the process letter given to the bidders, because in the bidding procedure the sellers made no fixed requirements to the bidders regarding purchase price instalments before closing, therefore also a possible request of a bidder to replace cash collaterals by other valuable collaterals to secure the purchase price would have had no impact on the evaluation of the bids.

Urges the Commission to conduct a study to ensure that accounting standards used by financial institutions give a genuinely true and fair view of banks’ financial health; points out that accounts are the main source of information for an investor to understand whether or not a company is a going concern or not; notes that auditors can only sign off accounts if they are true and fair, independent of the financial standards used by preparers of financial statements; believes that if auditors are unsure that a company is a going concern they should not sign off the company’s accounts, even if they have been drawn up in line with accounting standards; point out that this should, however, be a driver of better management of the company in question; suggests that international financial reporting standards do not necessarily give a true and fair view of accounts, as shown by numerous examples of banks collapsing despite their accounts having been signed off by auditors;

Dans la réponse par elle réservée à la question E-1269/07 de l’auteur de la présente question, M Hübner, membre de la Commission des Communautés européennes, ne dit pas, hélas, comment il est possible que la société ELANET (à laquelle, de l’aveu même de M Hübner, la Fédération des industries grecques, ou SEB, est partie prenante), soit impliquée dans l’adoption de 299 des 300 (!) dossiers qui avaient été soumis au ministère de l’Économie, ce dont la presse grecque s’était faite l’écho (voir Ethnos du 13 décembre 2006, par exemple).
Commissioner Hübner failed to indicate in reply to my question No. E-1269/07 how it is that the Elanet company (in which she herself admits that the Greek Federation of Industry - SEV - has a vested interest) is involved in the approval of 299 of the 300(!) applications submitted to the Finance Ministry, as pointed out by the Greek press (for example ‘Ethnos’ of 13 December 2006). I am, therefore, compelled, as I also mentioned in my above question, to raise the matter before the European Parliament in plenary in the hope of obtaining a full reply from (the otherwise likeable) Mrs Hübner.
