Emphasises that, on the other hand, following a complaint from users, the Commission's Directorate-General for Competition intervened by instituting a procedure against CISAC (International Confederation of Societies of Authors and Composers), which includes 24 European collecting societies amongst its members; points out that the effect of the decision taken in this regard will be to preclude all attempts by the parties concerned to act together in order to find appropriate solutions – such as, for instance, a system for the clearing of rights at the European level – and to leave the way open to an oligopoly of a number of large collecting societies linked by exclusive agreements to publishers belonging to the worldwide repertoire; believes that the result will be a restriction of choice and the extinction of small collecting societies to the detriment of minority cultures;

Criticises the Commission for not setting out any ideas or agenda as to how to shape the appropriate framework in international negotiations in order to allow for services of general interest to be provided, on a democratically chosen basis, to the citizens of the EU and all other countries; urges the Commission to enter immediately into discussions with Parliament and civil society on possible challenges to such services arising from international negotiations, in particular the GATS and the WTO’s 2003 Ministerial Conference in Cancun; calls for greater transparency in the preparations for such negotiations, enabling Parliament and civil society to play their proper roles of political and public oversight;

(10) Whereas in the ministerial declaration adopted during the International Ministerial Conference entitled 'Global information networks: Realising the potential`, held in Bonn on 6 to 8 July 1997 at the initiative of the German Government, Ministers stressed the role which the private sector can play in protecting the interests of consumers and in promoting and respecting ethical standards, through properly functioning systems of self-regulation in compliance with and supported by the legal system; whereas they encouraged industry to implement open, platform-independent content rating systems, and to propose rating services which meet the needs of different users and take account of Europe's cultural and linguistic diversity; whereas ministers further recognised that it is crucial to build trust and confidence in global information networks by ensuring that basic human rights are respected and by safeguarding the interests of society in general, including producers and consumers;

It is disappointing to note that most of the specific problems, such as sources of finance, international cooperation, the modernization of national legislation and even the need to link voluntary organizations/foundations with developments in the information society, would no longer arise or would be much less acute if these bodies were equipped with an instrument of cooperation at Community level: we are of course referring to the Statute for a European Association which Parliament has called for in two reports drawn up by this committee- see the FONTAINE Report on non-profit-making associations (Doc. A2-196/86) and the VAYSSADE Report on a Statute for a European Cooperative Society and other undertakings in the mutual sector in general (Doc. A3-312/90) - and it approved the proposal for a regulation relating to that statute through the VAYSSADE Report which concerned the statutes for a European association, European cooperative society and a European mutual society (Doc. A3-0001/93) OJ C 42 of 15.2.1993, pp. 84 to 122).
