In that context, in the light of the objectives pursued by the Netherlands fiscal unity regime ., is the situation of the (sub-)sub-subsidiaries Alphabet Holding, HP Holding and Alpha Holding objectively comparable . to (i) the situation of companies established in the Netherlands which are (sub-)subsidiaries of an intermediate holding company established in the Netherlands which has not elected to be integrated in a fiscal unity with its parent company established in the Netherlands, and which therefore, as sub-subsidiaries, similarly to Alphabet Holding, HP Holding and Alpha Holding, have no access to the fiscal unity regime with — exclusively — its grandparent company, or to (ii) the situation of sub-subsidiaries established in the Netherlands which, together with their parent company/intermediate holding company established in the Netherlands, have elected to form a fiscal unity with their (grand-)parent company established in the Netherlands and whose activities and assets therefore, unlike those of Alphabet Holding, HP Holding and Alpha Holding, are consolidated for tax purposes?

L’article 3, paragraphe 1, du règlement (CE) no 661/2008 du Conseil, du 8 juillet 2008, instituant un droit antidumping définitif sur les importations de nitrate d’ammonium originaire de Russie à la suite d’un réexamen au titre de l’expiration des mesures conformément à l’article 11, paragraphe 2, et d’un réexamen intermédiaire partiel conformément à l’article 11, paragraphe 3, du règlement (CE) no 384/96, doit être interprété en ce sens qu’une société établie dans un État membre qui a acheté du nitrate d’ammonium d’origine russe, par l’intermédiaire d’une autre société également établie dans un État membre, en vue de son importation dans l’Union européenne, ne peut pas être considérée comme le premier client indépendant dans l’Union européenne, au sens de cette disposition, et ne peut donc pas bénéficier de l’exonération du droit antidumping définitif institué par le règlement no 661/2008 pour ce nitrate d’ammonium.
Article 3(1) of Regulation (EC) No 661/2008 of 8 July 2008, imposing a definitive anti-dumping duty on imports of ammonium nitrate originating in Russia following an expiry review pursuant to Article 11(2) and a partial interim review pursuant to Article 11(3) of Regulation (EC) No 384/96, must be interpreted as meaning that a company established in a Member State, which purchased ammonium nitrate originating in Russia, through another company also established in a Member State, with a view to importing it into the Union, may not be considered to be the first independent customer in the Union, within the meaning of that provision, and may not therefore be eligible for the exemption from definitive anti-dumping duty laid down by that regulation in respect of the ammonium nitrate.

In answering the first sentence of Question 1, does it still make a difference . whether the domestic companies concerned are held by one single intermediate holding company (at a higher level of the group structure) in the other Member State or whether, as in the case of Alphabet Holding, HP Holding and Alpha Holding, they are held by two (or more) intermediate holding companies — albeit situated in that other Member State — (at two or more higher levels of the group structure)?

Pour faire face aux situations imprévues ou aux évolutions et aux besoins nouveaux, la Commission peut, à la suite de l'évaluation intermédiaire d'Horizon 2020 visée à l'article 32, paragraphe 3, et des résultats de l'évaluation de l'EIT visée à l'article 32, paragraphe 2, revoir, dans le cadre de la procédure budgétaire annuelle, les montants alloués aux priorités et aux objectifs spécifiques "Propager l'excellence et élargir la participation" et "La science avec et pour la société", tels qu'ils sont fixés au paragraphe 2 du présent article, ainsi que la répartition indicative par objectif spécifique au sein de ces priorités, telle qu'elle est établie à l'annexe II, de même que la contribution à l'EIT fixée au paragraphe 3 du présent article.

In order to respond to unforeseen situations or to new developments and needs the Commission may, following the interim evaluation of Horizon 2020 as referred to in Article 32(3) and the results of the review of the EIT referred to in Article 32(2), within the annual budgetary procedure review the amounts set out for the priorities and the specific objectives 'Spreading excellence and widening participation' and 'Science with and for society' in paragraph 2 of this Article and the indicative breakdown by specific objectives within these priorities set out in Annex II and the contribution to the EIT in paragraph 3 of this Article.

He proposed that the Court should reply as follows: '(1) Article 52 of the Treaty is to be interpreted as precluding the application of legislation of a Member State which prevents a company established in the territory of that State from obtaining tax relief in respect of losses incurred by another company, established in the same State and controlled by the first company through a holding company, in cases where the holding company's business consists, wholly or mainly, in holding shares of subsidiaries resident outside that State, in so far as such legislation constitutes a restriction on the exercise of the right of establishment in other Member States of the European Union.
