Une demande de réexamen intermédiaire partiel (ci-après dénommée le «présent réexamen») conformément à l’article 11, paragraphe 3, du règlement de base a été soumise par JSC Acron, JSC Dorogobuzh et leur négociant lié Agronova International Inc., qui appartiennent à la société holding «Acron» (ci-après dénommé le «requérant»).
A request for a partial interim review (‘the present review’) pursuant to Article 11(3) of the basic Regulation was lodged by JSC Acron, JSC Dorogobuzh and their related trading company Agronova International Inc., members of ‘Acron’ Holding Company (‘the applicant’).

Par sa décision 2008/577/CE du 4 juillet 2008 (8), la Commission a accepté les engagements offerts par plusieurs producteurs-exportateurs, dont les producteurs-exportateurs russes liés Joint Stock Company Acron et Joint Stock Company Dorogobuzh (la société holding «Acron»), dans le contexte de la procédure antidumping concernant les importations de nitrate d’ammonium originaire de Russie et d’Ukraine.
By Decision 2008/577/EC of 4 July 2008 (8), the Commission accepted undertaking offers submitted by several exporting producers, including the related Russian exporting producers Joint Stock Company Acron and Joint Stock Company Dorogobuzh (‘Acron’ Holding Company), in connection with the anti-dumping proceeding concerning imports of ammonium nitrate originating in Russia and Ukraine.

Durant l’enquête, la société holding Acron a constitué une autre société commerciale sous le nom d’Agronova Europe AG (ci-après dénommée «Agronova Europe») qui, selon ses dires, reprendrait la plupart des opérations avec les clients européens dans le but de remplacer progressivement Agronova.
During the investigation, the ‘Acron’ Holding Company established another trading company, namely Agronova Europe AG (‘Agronova Europe’) which it claimed would take over most of the trading with European clients and thereby gradually replace Agronova.

Le requérant soutient que les circonstances dans lesquelles l’engagement de prix a été accepté ont changé, en particulier en raison de l’intégration de la société Agronova International Inc., un nouveau négociant établi aux États-Unis, dans la société holding Acron, et que ces changements présentent un caractère durable.
The applicant alleged that the circumstances under which the price undertaking was granted changed, in particular that Agronova International Inc., a newly established trader in the USA, was incorporated into the ‘Acron’ Holding Company.

Sur cette base, la Commission a, par le règlement (CE) no 1001/2004 (8), accepté trois engagements au titre de l’élargissement offerts par les producteurs-exportateurs russes Open Joint Stock Company (OJSC) Mineral and Chemical Company «Eurochem», membre du groupe de sociétés «Eurochem», et JSC Acron and JSC Dorogobuzh, membres de la société holding «Acron», et par le producteur-exportateur ukrainien Open Joint Stock Company (OJSC) Azot Cherkassy.
On this basis, the Commission, by Regulation (EC) No 1001/2004 (8), accepted three enlargement undertakings offered by the Russian exporting producers Open Joint Stock Company (OJSC) Mineral and Chemical Company ‘Eurochem’, member of the Eurochem group of companies, and JSC Acron and JSC Dorogobuzh, members of ‘Acron’ Holding Company ‘Acron’, and Ukrainian exporting producer, Open Joint Stock Company (OJSC) Azot Cherkassy ‘Cherkassy’.
