C’est avec le même objectif que le Conseil a adopté le règlement (CEE) n° 2137/85 relatif au groupement européen d'intérêt économique et le règlement (CE) n° 2157/2001 relatif au statut de la société européenne, ainsi que la directive 2005/56/CE sur les fusions transfrontalières des sociétés de capitaux.
With the same aim, the Council adopted Regulation (EEC) No 2137/85 relating to European Economic Interest Grouping and Regulation (EC) No 2157/2001 relating to a Statute for a European Company, and Directive 2005/56/EC on cross-border mergers of limited liability companies.

S’agissant des obstacles qui ne sont pas de nature fiscale et, en particulier, des obstacles du droit des sociétés imputables à l’État de résidence de l’entreprise acquise, la Commission est d’avis que les obstacles aux regroupements d’entreprises ont été supprimés au sein du marché commun à compter du 8 octobre 2004, date de l’entrée en vigueur de la directive 2001/86/CE du Conseil du 8 octobre 2001 complémentant le statut de la Société européenne pour ce qui concerne l’implication des travailleurs (56) ainsi que du règlement (CE) no 2157/2001 du Conseil du 8 octobre 2001 relatif au statut de la société européenne (SE) (57) ou, au plus tard, à compter de la date de transposition (58) de la directive sur les fusions transfrontalières.
As regards non-tax barriers and in particular company law barriers attributable to the target company’s country of residence, the Commission considers that since 8 October 2004, the date when Council Directive 2001/86/EC of 8 October 2001 supplementing the Statute for a European company with regard to the involvement of employees (56), together with Council Regulation (EC) No 2157/2001 of 8 October 2001 on the Statute for a European company (SE) (57) or, at the latest, since the date of transposal (58) of the Cross-border Mergers Directive, obstacles to business combinations have been eliminated within the common market.

The Commission supports the Committee’s initiatives to promote and structure dialogue and consultation with European organised civil society and reinforce relations with the network of economic and social councils and similar institutions in the Member States, so that the Committee can play a full part as a vector for the expectations and aspirations of organised civil society.

Elle poursuit ainsi un but d'intérêt général européen.
