4. Lorsqu'un nouveau producteur-exportateur de la République populaire de Chine fournit à la Commission des éléments de preuve suffisants pour établir: a) qu'il n'a pas exporté vers l'Union le produit décrit au paragraphe 1 au cours de la période comprise entre le 1er juillet 2009 et le 30 juin 2010 (période d'enquête initiale), b) qu'il n'est lié à aucun exportateur ou producteur de la République populaire de Chine soumis aux mesures antidumping instituées par le présent règlement, c) qu'il a effectivement exporté vers l'Union le produit concerné ou qu'il s'est engagé d'une manière irrévocable par contrat à exporter une quantité importante vers l'Union après la fin de la période d'enquête initiale, la Commission peut modifier l'annexe I en ajoutant le nouveau producteur-exportateur aux sociétés ayant coopéré non retenues dans l'échantillon de l'enquête initiale et donc soumises au droit moyen pondéré n'excédant pas 56,9 %.
4. Where any new exporting producer in the People's Republic of China provides sufficient evidence to the Commission that: (a) it did not export to the Union the product described in paragraph 1 in the period between 1 July 2009 and 30 June 2010 (original investigation period), (b) it is not related to any exporter or producer in the People's Republic of China which is subject to the anti-dumping measures imposed by this Regulation, (c) it has actually exported to the Union the product concerned or it has entered into an irrevocable contractual obligation to export a significant quantity to the Union after the end of the original investigation period, the Commission may amend the Annex I by adding the new exporting producer to the cooperating companies not included in the sample of the original investigation and thus subject to the weighted average duty of not exceeding 56.9 %.

5. L'application des taux de droit antidumping individuels précisés pour les sociétés visées au paragraphe 2 est subordonnée à la présentation aux autorités douanières des États membres d'une facture commerciale en bonne et due forme, sur laquelle doit apparaître une déclaration datée et signée par un représentant de l'entité délivrant une telle facture, identifié par son nom et sa fonction, et rédigée comme suit: «Je, soussigné(e), certifie que le volume de tubes et tuyaux sans soudure en acier inoxydable vendu à l'exportation vers l'Union européenne et couvert par la présente facture (indication du volume) a été produit par (raison sociale et adresse de la société) (code additionnel TARIC) en/au/aux [pays concerné].
5. The application of the individual anti-dumping duty rates specified for the companies mentioned in paragraph 2 shall be conditional upon presentation to the customs authorities of the Member States of a valid commercial invoice, on which shall appear a declaration dated and signed by an official of the entity issuing such invoice, identified by his/her name and function, drafted as follows: ‘I, the undersigned, certify that the (volume) of seamless pipes and tubes of stainless steel sold for export to the European Union covered by this invoice was manufactured by (company name and address) (TARIC additional code) in the (country concerned).

In response to this argument it was considered that while the relaxation of the Generalised System of Preferences rules could have contributed to the company’s motivation to export to the Union, it does not contradict the finding that the company started its operation after the anti-dumping duties against the PRC were increased and that it sourced the parts mainly from the PRC (see recital 73).
