Concernant la sixième mesure, à savoir le DER, la société d'assurance Union affirme qu'elle pourrait éventuellement satisfaire aux conditions établies dans la jurisprudence de l'affaire Altmark pour ce qui est de la compensation de service public, ou qu'elle pourrait être compatible avec le marché intérieur conformément à l'article 106, paragraphe 2, du traité, ce qui nécessite un nouvel examen portant sur la possibilité qu'elle puisse comporter une approche discriminatoire en faveur du bénéficiaire net du DER, c'est-à-dire SZP/VšZP.
As regards the sixth measure, the RES, Union Health Insurance claims that it could potentially fulfil the conditions of the Altmark case-law for public service compensation or may be compatible with the internal market under Article 106(2) of the Treaty, requiring further investigation into its potential discriminatory approach in favour of the net recipient of the RES, i.e. SZP/VZP.
