The draft regulation covers definitions, the calculation of net short positions, covered sovereign credit default swaps, notification thresholds, liquidity thresholds for suspending restrictions, significant falls in the value of financial instruments and adverse events.

Les dispositions du présent règlement sont étroitement liées les unes aux autres, puisque d’une part, les seuils de notification et de publication et la définition des contrats d’échange sur risque de crédit non couverts dépendent de la définition et des méthodes de calcul des positions courtes, et que d’autre part, les dispositions relatives aux baisses de valeur significatives d’instruments financiers, à la baisse de liquidité des marchés de la dette souveraine et à la définition des événements défavorables sont inextricablement liées entre elles.
The provisions in this Regulation are closely linked, since the notification and publication thresholds and the determination of uncovered credit default swaps depend on the definitions and the methods of calculation of short positions while the provisions on significant falls in the value of financial instruments and falls in the liquidity of sovereign debt markets and the determination of adverse events are inextricably linked.

L’autorité compétente dont relève le territoire d’où émane la suspension ou le retrait exige que les marchés réglementés, les autres MTF et OTF et les internalisateurs systématiques qui relèvent de sa compétence et négocient le même instrument financier ou les instruments dérivés visés aux points 4) à 10) de la section C de l’annexe I de la présente directive qui sont liés ou font référence à cet instrument financier, suspendent ou retirent également cet instrument financier ou ces instruments dérivés de la négociation, lorsque la suspension ou le retrait résulte d’un abus présumé de marché, d’une offre publique d’achat ou de la non-communication d’informations privilégiées relatives à l’émetteur ou à l’instrument financier en violation des articles 7 et 17 du règlement (UE) no 596/2014, sauf dans les situations où les intérêts des investisseurs ou le fonctionnement ordonné du marché pourraient être affectés d’une manière significative par une telle suspension ou un tel retrait.
The competent authority, in whose jurisdiction the suspension or removal originated, shall require that regulated markets, other MTFs, other OTFs and systematic internalisers, which fall under its jurisdiction and trade the same financial instrument or derivatives referred to in points (4) to (10) of Section C of Annex I to this Directive that relate or are referenced to that financial instrument, also suspend or remove that financial instrument or derivatives from trading, where the suspension or removal is due to suspected market abuse, a take-over bid or the non-disclosure of inside information about the issuer or financial instrument infringing Articles 7 and 17 of Regulation (EU) No 596/2014 except where such suspension or removal could cause significant damage to the investors’ interests or the orderly functioning of the market.

6. Si un instrument dérivé, y compris les contrats financiers avec paiement d’un différentiel, est négocié sur une plate-forme de négociation et a pour seul instrument financier sous-jacent un instrument financier dont la baisse de valeur significative est définie au présent article et à l’article 23, paragraphe 5, du règlement (UE) no 236/2012, cet instrument dérivé est considéré comme ayant subi une baisse de valeur significative en cas de baisse significative de cet instrument financier sous-jacent.
6. Where a derivative, including financial contracts for difference, is traded on a trading venue and has as its only underlying financial instrument, a financial instrument for which a significant fall in value is specified in this Article and Article 23(5) of Regulation (EU) No 236/2012, a significant fall in value in that derivative instrument shall be considered to have occurred when there has been a significant fall in that underlying financial instrument.

A significant fall in value for financial instruments falling under the categories of derivatives listed in points (4) to (10) of Section C of Annex I to Directive 2004/39/EC and which have a sole underlying financial instrument that is traded on a trading venue and for which a significant fall in value has been specified in accordance with Article 2 or Article 3, shall be calculated by reference to the significant fall in value of the underlying financial instrument.

It has given particular support to the implementation of the MedWet programme; Noting that all these provisions and commitments have not led to the achievement of all of their objectives for wetlands, owing in particular to insufficient integration between the different policies, especially on funding through existing Community financial instruments, and between the corresponding development strategies; Acknowledging that it is a matter of priority to halt the disappearance and degradation of wetlands, to ensure better management and to improve and restore such areas; Takes note of the analysis, the conclusions and the recommendations which the Commission has put forward in its communication on wise use and conservation of wetlands and approves its general approach; Emphasizes the need for better coordination between Community policies and for better coordination between existing Community financial instruments; Maintains that activities in the wetlands must be pursued in strict compliance with the principles of integration and of regional development based on integrated territorial development, and affirms that projects likely to affect such areas significantly should be the subject of an environmental impact assessment in accordance with the provisions of the Impact Assessment Directive, as amended, or an assessment in terms of their effects in accordance with the provisions of the Habitats Directive, as appropriate.
