TRADUCTIONS EN CONTEXTE

154. demande à la Commission d’utiliser tous les instruments à sa disposition pour favoriser une approche plus coordonnée à l'égard des pays développés afin de promouvoir une réciprocité accrue en matière fiscale, notamment au niveau de l’échange d’informations avec les États-Unis d’Amérique suite à l’entrée en vigueur de la loi sur la conformité fiscale des comptes étrangers; demande également à la Commission, dans le cadre de l'accord du 27 mai 2015 entre l'Union européenne et la Suisse relatif à l'échange automatique de renseignements relatifs aux comptes financiers, de surveiller de très près, afin de préserver le marché unique, la suppression progressive prévue de certaines pratiques fiscales dommageables utilisées en Suisse, conformément aux lignes directrices du plan d'action BEPS, ainsi que la non-introduction à l'avenir d'autres mesures fiscales dommageables; invite la Commission, lors des négociations en cours avec la Suisse, à suggérer l'introduction de dispositions sur les entreprises sous contrôle étranger en droit suisse; insiste pour que la Commission s'assure que la Suisse suit l'approche de l'Union en matière fiscale et en fasse rapport au Parlement;
154. Calls on the Commission to use all the tools at its disposal to foster a more coordinated approach vis-à-vis developed countries in order to promote greater reciprocity in tax matters, in particular with regard to the exchange of information with the United States of America following the entry into force of the Foreign Account Tax Compliance Act; calls also on the Commission, against the background of the agreement of 27 May 2015 between the EU and Switzerland on the automatic exchange of financial account information, to monitor carefully, with a view to preserving the single market, the agreed phasing out of some harmful tax practices in Switzerland, in line with BEPS guidelines, and that no new harmful tax measures are introduced in the future; calls on the Commission in its ongoing negotiations with Switzerland to suggest the introduction of controlled foreign companies rules in Swiss law; insists that the Commission must ensure that Switzerland follows the EU approach on taxation and report to Parliament;

The Commission shall inform the Swiss Confederation and the Member States of the notifications given in accordance with point (d) of Article 1(1) of the Agreement between the European Union and the Swiss Confederation on the automatic exchange of financial account information to improve international tax compliance as following from the Amending Protocol.

Calls for the obstacles to cross-border professional mobility to be removed in order to deepen the internal market; stresses, to that end, the importance of promoting language learning and providing better information and practical support to jobseekers, in particular through the EURES network, in Switzerland and in all the EEA countries; welcomes, therefore, Switzerland’s active involvement in EURES network activities, in particular in cross-border regions; calls on Switzerland to continue to build up its transnational and cross-border EURES services, in accordance with the current EURES Regulation, with a view to enhancing worker mobility and creating a genuinely integrated employment market between the EU and Switzerland; with a view, to enhancing worker mobility, also encourages efforts to identify a broad range of emerging industries and key growth sectors in which the EEA countries, Switzerland and the Member States should focus on developing their skills base, in order to better match skills and qualifications with supply and demand;

Information communicated or acquired in any form whatsoever pursuant to this Annex will be covered by professional confidentiality and protected in the same way as similar information is protected by the national legislation of Switzerland and by the corresponding provisions applicable to the Community institutions.

Les procédures nécessaires à l'entrée en vigueur de l'accord entre la Communauté européenne et la Confédération suisse concernant la participation de la Suisse à l'Agence européenne pour l'environnement et au Réseau européen d'information et d'observation pour l'environnement, signé à Luxembourg le 26 octobre 2004, ayant été accomplies le 27 février 2006, cet accord entrera en vigueur le 1er avril 2006, conformément à son article 20.
The procedures necessary for the entry into force of the Agreement between the European Community and the Swiss Confederation concerning the participation of Switzerland in the European Environment Agency and the European Environment Information and Observation Network, signed in Luxembourg on 26 October 2004, having been completed on 27 February 2006, this Agreement will enter into force, in conformity with its Article 20, on 1 April 2006.

En ce qui concerne la Suisse, et sauf dans la mesure où elle instaure un échange d'informations sur les problèmes associés au retour des ressortissants de pays tiers autres que ceux qui ne remplissent pas ou ne remplissent plus les conditions prévues pour bénéficier d'un court séjour, applicables sur le territoire d'un État membre en vertu des dispositions de l'acquis de Schengen, la présente décision constitue un développement des dispositions de l'acquis de Schengen au sens de l'accord signé entre l'Union européenne, la Communauté européenne et la Confédération suisse sur l'association de la Confédération suisse à la mise en œuvre, à l'application et au développement de l'acquis de Schengen (7), qui relèvent des domaines visés à l'article 1er, points A), B), C) et E), de la décision 1999/437/CE lu en liaison avec l'article 4, paragraphe 1, des décisions 2004/849/CE du Conseil du 25 octobre 2004 (8) et 2004/860/CE du Conseil du 25 octobre 2004 (9) relatives à la signature, au nom de l'Union européenne de la Communauté européenne, respectivement, et à l'application provisoire de certaines dispositions dudit accord.
As regards Switzerland, except insofar as it establishes an exchange of information on the problems associated with the return of third-country nationals other than those who do not fulfil or who no longer fulfil the conditions for a short stay applicable within the territory of a Member State by virtue of the provisions of the Schengen acquis, this Decision constitutes a development of the provisions of the Schengen acquis within the meaning of the Agreement signed between the European Union, the European Community and the Swiss Confederation concerning the implementation, application and development of the Schengen acquis (7), which fall within the areas referred to in Article 1, points A, B, C and E of Decision 1999/437/EC read in conjunction with Article 4(1) of Council Decision 2004/849/EC of 25 October 2004 (8) and of Council Decision 2004/860/EC of 25 October 2004 (9) on the signing of that Agreement on behalf of the European Union and the European Community, respectively, and on the provisional application of certain provisions thereof.

WHEREAS THE SWISS GOVERNMENT HAS INFORMED THE COMMUNITY THAT CERTAIN CHEESES FROM THIRD COUNTRIES WILL BE IMPORTED INTO SWITZERLAND AT PRICES ABOVE THOSE CURRENT IN INTERNATIONAL TRADE ; WHEREAS TO ENSURE THAT COMMUNITY PRODUCTS ARE NOT IMPORTED INTO SWITZERLAND AT PRICES LOWER THAN THOSE OF CHEESES FROM THIRD COUNTRIES , THE COMMUNITY WILL REQUIRE THE REFUND ON THE EXPORT OF THOSE CHEESES TO SWITZERLAND TO BE FIXED AT A LEVEL LOWER THAN THAT FOR OTHER DESTINATIONS ; WHEREAS AN APPROPRIATE CONTROL PROCEDURE SHOULD BE INTRODUCED TO ENSURE OBSERVANCE OF THE PRICE LEVEL ENVISAGED FOR IMPORTS OF THESE CHEESES INTO SWITZERLAND FROM THE COMMUNITY ;
