Regarding the particular lawyer of that law firm, to which complainant 3 has referred in its complaint, Germany has also explained the following: (a) that lawyer worked for the Land from May 2012 until April 2013, i.e. before the initiation of the tender process in June 2013; (b) that lawyer was not in any contact with the Land or the Federal Republic of Germany during the tender process; (c) that lawyer never advised the Land or the sellers in relation to the bidding process; and (d) the same lawyer only participated as an independent expert in the hearing of the Land's parliament on 20 June 2013 concerning the law for the public access to the Nürburgring racetrack.

Moreover, the new administrative interpretation of Article 12(5) TRLIS introduced by the Spanish authorities in March 2012 has enlarged the scope of application of Article 12(5) TRLIS since the measure would now be applicable not only to financial goodwill arising from direct acquisitions of shareholdings of non-resident companies, but also to the financial goodwill arising from indirect acquisitions of shareholdings of non-resident companies through the acquisition of shareholdings of a holding company.

On 21 March 2012, following a request for a tax opinion by a Spanish company, the DGT adopted the binding interpretation V0608-12 (21), which establishes that Article 12(5) TRLIS would allow the deduction of financial goodwill not only from direct acquisitions of shareholdings of operating companies, but also from indirect acquisition of shareholdings resulting from a previous direct acquisition of shareholdings of a holding company.

Welcomes the idea of encouraging the development of guides on how to apply existing Directives - which should be accompanied by better training material and information on what works, especially for SMEs, in high-risk sectors and situations where there are specific, persistent and recurrent risks, and take account of gender, age and cultural factors; requests more detail as to the "assessments.at company level" of implementation; underlines that the social partners should not only be involved in work on these guides but also, more systematically and comprehensively, in the implementation process itself; asks the Commission to develop special programmes to this end for the candidate countries with a view to encouraging the actual implementation of working environment legislation at company level in these countries;
