TRADUCTIONS EN CONTEXTE

Par ses pourvois, Freixenet SA (ci‑après «Freixenet») demande l’annulation des arrêts du Tribunal de l’Union européenne du 27 avril 2010, Freixenet/OHMI (Bouteille émerisée blanche) (T‑109/08, ci-après l’«arrêt T‑109/08»), et Freixenet/OHMI (Bouteille émerisée noire mate) (T‑110/08, ci-après l’«arrêt T‑110/08») (ci-après, ensemble, les «arrêts attaqués»), par lesquels le Tribunal a rejeté ses recours formés contre, respectivement, les décisions de la première chambre de recours de l’Office de l’harmonisation dans le marché intérieur (marques, dessins et modèles) (OHMI), du 30 octobre 2007 (affaire R 97/2001‑1) et du 20 novembre 2007 (affaire R 104/2001‑1), concernant des demandes d’enregistrement des signes représentant une bouteille émerisée blanche ainsi qu’une bouteille émerisée noir mat comme marques communautaires (ci‑après les «décisions litigieuses»).
By its appeals, Freixenet SA (‘Freixenet’) seeks to have set aside the judgments of the General Court of the European Union of the 27 April 2010, in Case T-109/08 Freixenet v OHIM (Frosted white bottle) (‘the judgment in T-109/08’), and in Case T-110/08 Freixenet v OHIM (Frosted black matt bottle) (‘the judgment in T‑110/08’) (together, ‘the judgments under appeal’), by which the Court dismissed its actions against, respectively, the decisions of the First Board of Appeal of the Office for Harmonisation in the Internal Market (Trade Marks and Designs) (OHIM) of 30 October 2007 (case R 97/2001-1) and of 20 November 2007 (case R 104/2001-1), concerning applications for registration of signs representing a frosted white bottle and a frosted black matt bottle as Community trade marks (‘the contested decisions’).

Au soutien de ses pourvois, Freixenet invoque trois moyens, tirés respectivement, le premier, d’une violation des articles 38, paragraphe 3, et 73 du règlement nº 40/94 ainsi que de l’article 296 TFUE et de l’article 6 de la convention européenne de sauvegarde des droits de l’homme et des libertés fondamentales, signée à Rome le 4 novembre 1950, le deuxième, d’une violation de l’article 7, paragraphe 1, sous b), de ce règlement et, le troisième, d’une violation de l’article 7, paragraphe 3, dudit règlement.
In support of its appeals, Freixenet puts forward three pleas in law, alleging, first, infringement of Articles 38(3) and 73 of Regulation No 40/94, and Article 296 TFEU and Article 6 of the European Convention for the Protection of Human Rights and Fundamental Freedoms, signed in Rome on 4 November 1950, second, infringement of Article 7(1)(b) of Regulation No 40/94 and, third, infringement of Article 7(3) of that regulation.

Freixenet ayant conclu à la condamnation de l’OHMI et celui-ci ayant succombé en ses moyens, il y a lieu de le condamner aux dépens relatifs tant aux procédures de première instance qu’aux pourvois.
Since Freixenet has applied for costs to be awarded against OHIM, and since OHIM has been unsuccessful, it must be ordered to pay the costs of the proceedings at first instance and in the appeals.

Dans ces conditions, il y a lieu d’accueillir le deuxième moyen soulevé par Freixenet et d’annuler les arrêts attaqués, sans qu’il soit besoin de procéder à l’examen des autres moyens des pourvois.
In those circumstances, the second plea put forward by Freixenet must be upheld and the judgments under appeal set aside, without it being necessary to examine the other grounds of the appeals.
