IN-CONTEXT TRANSLATIONS

À la suite de plaintes déposées par des concurrents, la Commission a étendu ses enquêtes, d'abord en 2007, afin de déterminer si l'obligation de service universel de Deutsche Post avait fait l'objet d'une surcompensation allant au-delà de celle constatée dans la décision de 2002 (voir IP/07/1312), et ensuite en 2011, afin d'examiner de plus près les subventions déchargeant Deutsche Post du coût des retraites de ses fonctionnaires (voir IP/11/554).

Furthermore, the Directive harmonised the conditions to finance the provision of such universal services (e.g. definition of services that can be reserved) and the conditions in which non-reserved services can be provided (e.g. using authorisation or licencing systems to impose universal service obligations on operators providing services which are within the scope of the universal service and the option for Member States to oblige such operators to pay into a compensation fund to cover eventual shortfalls in revenue that the universal service provider might suffer as a result of the extra costs imposed by its universal service obligations).

THE COUNCIL OF THE EUROPEAN UNION, Having regard to the Treaty establishing the European Community, Having regard to the Green Paper on the development of the single market for postal services, published on 11 June 1992; Having regard to the communication from the Commission on guidelines for the development of Community postal services; Whereas the development of postal services is an important feature of the development of the single market for the promotion of the economic and social development of the Community and its Member States; Whereas the provisions of the Treaty on the freedom to provide services cover the postal sector; Whereas the Green Paper and the abovementioned communication identify the aspects of postal services which are of Community interest; Whereas in view of these aspects it appears that efforts should be made at Community level to improve the efficiency and quality of postal services; Whereas the Commission has undertaken broad public consultation and has received contributions from interested parties in the postal sector; Whereas it is necessary to fix the main objectives of the development of postal services in the Community, in accordance with the Treaty; 1. GIVES ITS SUPPORT: to the general approach contained in the Commission's Green Paper on the development of the single market for postal services; 2. TAKES NOTE OF: the consultation which took place between the interested parties and the resulting Commission communication on the guidelines for developing Community postal services, certain aspects of which nevertheless remain to be considered in detail with a view to reaching an overall agreement; 3. INVITE LA COMMISSION : 5.1 à proposer au Conseil, avant le 1er juillet 1994, les mesures nécessaires à la réalisation des objectifs énoncés aux points 4.1 à 4.11 ci-dessus afin de mettre en oeuvre rapidement une politique communautaire des services postaux, et notamment des mesures - contenant la définition du service universel, décrivant les obligations des prestataires du service universel et définissant les services réservables ; - relatives à la qualité du service universel intracommunautaire ; - relatives à la normalisation technique ; 5.2 à fonder ses propositions de réglementation future des services postaux sur des mesures transparentes, simples et faciles à gérer, afin que la surveillance et l'application soient assurées dans les meilleures conditions possibles ; 5.3 à contribuer activement, sur la base des travaux en cours et en coopération avec les Etats membres à la définition d'un cadre clair pour un nouveau système de frais terminaux en tenant compte de la nécessité d'assurer une protection satisfaisante contre les détournements de trafic reposant sur une exploitation abusive ; à communiquer par ailleurs au Conseil, avant le 1er mars 1994, tout autre action qui pourrait se révéler nécessaire dans ce domaine ; 6. INVITE LES ETATS MEMBRES : 6.1 à adhérer aux principaux objectifs, énoncés ci-dessus ; 6.2 à coopérer avec la Commission, notamment au sein du SOGP et du comité à haut niveau des autorités, dans la mise en oeuvre d'une politique communautaire des services postaux, conformément aux principaux objectifs décrits ci-dessus; 6.3 à mener, en association avec leurs prestataires du service universel, des discussions appropriées en vue de parvenir à un accord sur un nouveau système de frais terminaux, y compris des mesures pour assurer sa compatibilité avec les autres systèmes".
5. INVITES THE COMMISSION: 5.1. to propose to the Council, before 1 July 1994, the measures necessary for the realization of the policy goals set out under 4.1 to 4.11 above with a view to implementing without delay a Community policy on postal services, particularly measures - containing the definition of the universal service, describing the obligations of the providers of the universal service and defining the services which could be reserved; - relating to the quality of the universal intra-Community service; - relating to technical standardization; 5.2. to base its proposals for future regulation of the postal services on measures which are transparent, simple and easy to manage, to ensure the best possible conditions of monitoring and enforcement; 5.3. to contribute actively, on the basis of current proceedings and in co-operation with the Member States, to the definition of a clear framework for a new terminal dues system, bearing in mind the need to ensure satisfactory protection against deflections of trade based on abuse and to forward to the Council before 1 March 1994 any further action which could prove necessary in this area; 6. INVITES THE MEMBER STATES: 6.1. to support the above major policy goals; 6.2. to work in association with the Commission, particularly within the SOGP and a high-level committee of the authorities, in the implementation of a Community postal services policy in conformity with the above major policy goals; 6.3. to conduct, in association with their universal service providers, appropriate discussions in order to agree on a new terminal dues system, including steps to ensure compatibility with other systems".
