Voilà pourquoi je vous demande, ainsi qu'aux autres constructeurs automobiles, de revoir votre politique des prix de gros et de prendre les mesures suivantes : A) Envoi d'une lettre à tous vos concessionnaires de la Communauté : a) les assurant que lorsqu'ils recevront des commandes d'automobiles, même pour des modèles, des spécifications et des options qui ne sont normalement demandés que dans d'autres Etats membres, votre société sera disposée à les livrer dans des délais raisonnables, qui ne devront pas différer trop fortement, sans justification valable, des délais de livraison normaux appliqués dans l'Etat membre où les véhicules répondant à ces spécifications sont normalement vendus; b) les assurant que ces voitures leur seront fournies au prix de base qui est habituellement le leur (exception faite des coûts supplémentaires normalement supportés par votre société pour l'exécution d'une telle commande); si un client souhaite commander un modèle qui n'est pas normalement vendu dans l'Etat membre concerné, le prix devra s'aligner sur celui du modèle qui lui est le plus proche; c) leur rappelant que, conformément au règlement 123/85 et à la communication portant clarification de l'activité des intermédiaires en automobiles (JO C 329 du 18.12.1991), ils sont également libres de fournir des intermédiaires ou des concessionnaires établis dans d'autres Etats membres et les assurant qu'ils ne seront pénalisés en aucune façon s'ils le font.
To this end I am asking you and the other car manufacturers to review your wholesale pricing policies, and to take the following steps : A) Write a letter to all your dealers in the Community:- a) assuring them that when they receive orders for cars, even for models, specifications and options normally demanded only in some other Member State, your company is willing and able to supply them within a reasonable time period, which should not differ unjustifiably from the normal delivery period in the Member State where cars with those specifications are normally sold ; b) assuring them that such cars will be supplied to them at the same basic price as is customary for their regular supplies (apart from any extra costs necessarily incurred by your company in fulfilling such an order). Where a customer specifies a model not normally sold in the Member State concerned, the price should relate to the nearest equivalent model ; c) reminding them that, in accordance with Regulation 123/85 and the Notice clarifying the activities of intermediaries (O.J. Nº C329 - 18/12/1991), they are also free to supply intermediaries and to sell to dealers in other Member States, and assuring them that they will not be penalized in any way if they do so.
