Par sa décision 2008/46/CE (2), la Commission a institué l’Agence exécutive pour la recherche (ci-après l’«Agence») et lui a confié la gestion d’actions communautaires en matière de recherche en vue de l’exécution de tâches liées à la mise en œuvre du programme spécifique «Personnes» mettant en œuvre le septième programme-cadre de la Communauté européenne pour des activités de recherche, de développement technologique et de démonstration (2007-2013) (3), du programme spécifique «Capacités» mettant en œuvre le septième programme-cadre de la Communauté européenne pour des activités de recherche, de développement technologique et de démonstration (2007-2013) (4) et du programme spécifique «Coopération» mettant en œuvre le septième programme-cadre de la Communauté européenne pour des activités de recherche, de développement technologique et de démonstration (2007-2013) (5) du septième programme-cadre de la Communauté européenne pour des activités de recherche, de développement technologique et de démonstration (2007-2013) (6) (ci-après le «septième programme-cadre»).
By Decision 2008/46/EC (2), the Commission created the Research Executive Agency (hereinafter referred to as the Agency) and entrusted it with the management of Community actions in the field of research with a view of performance of tasks linked to the implementation of the specific programme ‘People’ implementing the Seventh Framework Programme of the European Community for research, technological development and demonstration activities (2007 to 2013) (3), specific programme ‘Capacities’ implementing the Seventh Framework Programme of the European Community for research, technological development and demonstration activities (2007 to 2013) (4) and specific programme ‘Cooperation’ implementing the Seventh Framework Programme of the European Community for research, technological development and demonstration activities (2007 to 2013) (5) of the Seventh Framework Programme of the European Community for research, technological development and demonstration activities (2007-2013) (6) (hereinafter referred to as the Seventh Framework Programme).

The Seventh Framework Programme has defined a series of criteria for the identification of areas for such Article 169 initiatives: the relevance to Community objectives, the clear definition of the objective to be pursued and its relevance to the objectives of the Seventh Framework Programme, the presence of a pre-existing basis (existing or envisaged national research programmes), European added value, a critical mass with regard to the size and number of programmes involved and the similarity of activities they cover, and the efficiency of Article 169 of the Treaty as the most appropriate means for achieving the objectives.

La décision 2006/971/CE du Conseil du 19 décembre 2006 relative au programme spécifique «Coopération» mettant en œuvre le septième programme-cadre de la Communauté européenne pour des activités de recherche, de développement technologique et de démonstration (2007-2013) (4) (ci-après dénommé «programme spécifique “Coopération”») encourage une approche multithématique des thèmes de recherche qui se rapportent à un ou plusieurs thèmes du septième programme-cadre et, dans ce contexte, définit l’initiative au titre de l’article 169 dans le domaine de la métrologie comme l’une des initiatives adaptées à une participation de la Communauté à des programmes de recherche nationaux mis en œuvre conjointement en vertu de l’article 169 du traité.
Council Decision 2006/971/EC of 19 December 2006 concerning the specific programme ‘Cooperation’ implementing the Seventh Framework Programme of the European Community for research, technological development and demonstration activities (2007 to 2013) (4) (the specific programme Cooperation) encourages a cross-thematic approach to research topics relevant to one or more themes of the Seventh Framework Programme, and in this context identified an Article 169 initiative in the field of metrology as one of the initiatives suitable for Community participation, in national research programmes jointly implemented on the basis of Article 169 of the Treaty.

According to the annual work programmes for 2007 and 2008 concerning the Specific Programme ‘Cooperation’, Transport (including aeronautics), implementing the Seventh Framework Programme of the European Community for research, technological development and demonstration activities (2007 to 2013), the Commission will provide annual contributions from the Seventh Framework Programme to the SESAR Joint Undertaking for a total estimated amount of EUR 350 million over the entire programme.

In accordance with the Seventh Framework Programme, the Community should have the right to agree on the conditions relating to its financial contribution to the Eurostars Joint Programme concerning the participation therein of any country associated with the Seventh Framework Programme or, where essential for implementing the Eurostars Joint Programme, of any other country, joining the Programme in the course of its implementation, in accordance with the rules and conditions set out in this Decision.

Considers that high levels of spending on research and development at national and EU level are necessary to enable the potential for energy efficiency to be exploited and criticises, in that respect, the decision of the Heads of State and Government as regards the financial framework for 2007-2013 and the reduction it implies for the budget of the seventh Framework Programme; considers it is essential that the EU lead by example by treating research expenditure within the seventh Framework Programme in the field of energy efficiency as a priority, taking into account the considerable potential for energy efficiency gains, reductions in emissions and a global market for new and efficient equipment and systems, and refraining from cutting the seventh Framework Programme budget in the energy efficiency sector, and calls for Member States, industry and the seventh Framework Programme to achieve successful demonstrations in all these areas; considers that the CIP must play an important role in the promotion and marketing of new technologies;

Participation in the activities of the Seventh Framework Programme should be facilitated through the publication of all relevant information, to be made available in a timely and user-friendly manner to all potential participants and the appropriate use of simple and quick procedures, free of unduly complex financial conditions and unnecessary reporting, in accordance with the Rules for Participation applicable to this Framework Programme, laid down in Regulation (EC) No 1906/2006 of the European Parliament and of the Council of 18 December 2006 laying down the rules for the participation of undertakings, research centres and universities in actions under the Seventh Framework Programme and for the dissemination of research results (2007-2013)
