Afin de rendre la programmation de la radiodiffusion publique plus libre et moins dépendante de contraintes commerciales, l’article 53, alinéa VI de la loi no 86-1067 du 30 septembre 1986 amendée sur la liberté de communication prévoit la diminution puis la disparition des messages publicitaires: «Les programmes diffusés entre vingt heures et six heures des services nationaux de télévision mentionnés au I de l’article 44, à l’exception de leurs programmes régionaux et locaux, ne comportent pas de messages publicitaires autres que ceux pour des biens ou services présentés sous leur appellation générique.
In order to increase the freedom of programming of public broadcasting and to reduce its dependence on commercial constraints, Article 53, Section VI of Law No 86-1067 of 30 September 1986, amended, on Freedom of Communication provides for the reduction then the discontinuance of advertising messages: ‘The programmes broadcasted between 20:00 and 06:00 of the national television services referred to in Section I of Article 44, with the exception of their regional and local programmes, shall not include any advertising messages other than those for goods or services presented under their generic name.

The Commission therefore considered that the relevant provisions of Law No 86-1067 of 30 September 1986, amended, (Articles 43-11, 44, 48 and 53) and the Decrees or official acts implementing it, in particular regarding the terms of reference (Decree No 2009-796 of 23 June 2009) and the agreement relating to objectives and means, were in conformity with the rules for the application of Article 106(2) of the TFEU on the assessment of aid to public broadcasting services set out in the Broadcasting Communication.
