Where it is expected that the setting of the TAC for a given year in accordance with paragraph 2 will result in a quantity of mature fish at the end of that year in excess of the target level indicated in Article 2, the TAC shall not be set in accordance with paragraph 2, but at a level of catches, which following a scientific evaluation carried out by STECF in the light of the most recent report of ICES, will result in an expected quantity of mature fish at the end of that year being equal to the target level indicated in Article 2.
