TRADUCTIONS EN CONTEXTE

Les autorités espagnoles renvoient, à cet égard, à une décision dans laquelle la Commission a autorisé une aide à la restructuration non notifiée en faveur d’une autre PME espagnole du même secteur que Pickman, Porcelanas del Principado (9), en se fondant sur le respect des conditions établies par les lignes directrices de 1999 et sur la distorsion limitée de la concurrence provoquée par l’aide.
In this regard, the Spanish authorities refer to a Decision in which the Commission approved non-notified restructuring aid in favour of another Spanish SME operating in the same sector as Pickman, Porcelanas del Principado (9), on the basis of the substantive compliance with the conditions under the 1999 Guidelines and of the limited distortion of competition resulting from the aid.

Par ailleurs, il semble que dans le cas de Pickman: i) il ne soit pas prévu que le plan de restructuration entraîne une augmentation de capacité; ii) les effectifs de l’entreprise seront réorganisés avec des compressions de personnel dans certaines usines et des investissements dans le secteur commercial et informatique; iii) la taille de Pickman soit limitée et puisse bénéficier d’aides; iv) la présence de l’entreprise sur le marché soit très limitée et l’était encore plus en 2003 par rapport à ses concurrents (voir l’étude de marché précitée); et, enfin, v) selon la carte des aides à finalité régionale en Espagne pour la période 2000-2006 (15), l’Andalousie était une région NUTS II et, sur la base de son PIB/EPA par habitant inférieur à 60 % de la moyenne communautaire, elle pouvait se prévaloir des dispositions de l’article 87, paragraphe 3, point a), du traité CE.
Moreover, in the case of Pickman, it appears that (i) the restructuring plan is not expected to lead to an increase in capacity; (ii) the company’s workforce will be reorganised, with downsizing taking place at certain plants and investment being made in the commercial and IT areas; (iii) Pickman is small, meaning that it can avail itself of aid; (iv) the company’s potential presence in the market is very limited and was even more limited in 2003, as compared to its competitors (see the market study referred to above); and (v) according to the Spanish regional aid map for the period 2000-2006 (15), Andalusia was a NUTS II area and, on the basis of its per capita GDP/PPS of below 60 % by comparison with the Community average, qualified under Article 87(3)(a) of the EC Treaty.
