Recalls that according to Articles 290 and 291 of the Treaty, delegated acts and implementing acts serve different needs and therefore one cannot be substituted for the other; considers that the delineation of delegated and implementing acts, as well as the correct and most appropriate choice of provisions to be included in the basic act, is an important political question which should be addressed and discussed at an early stage in the preparation of draft legislative reports by rapporteurs and shadow rapporteurs with the help of the Committee Secretariats and, in particular, of the Legal Service;

Pour les décisions relatives à des questions relevant de la compétence des États membres, la position à adopter par l’Union et ses États membres au sein du comité mixte est arrêtée par le Conseil statuant à l’unanimité sur proposition de la Commission ou de tout État membre, sauf si un État membre a fait savoir au secrétariat général du Conseil, dans un délai d’un mois à compter de l’adoption de cette position, qu’il ne peut accepter la décision du comité mixte qu’avec l’accord de ses organes législatifs, notamment en raison d’une réserve d’examen parlementaire.
4. For decisions concerning matters that fall within the competence of the Member States, the position to be taken by the Union and its Member States within the Joint Committee shall be adopted by the Council, acting by unanimity on a proposal from the Commission or from any Member State, unless a Member State has informed the General Secretariat of the Council within one month of the adoption of that position that it can only consent to the decision to be taken by the Joint Committee with the agreement of its legislative bodies, notably due to a parliamentary scrutiny reserve.

Wishes to see an assessment of the structure and capacity of the committee secretariats in order to ensure that they are ready to step up the quality of their legislative work; is surprised at recent claims that a mere 6% of staff work on committees and invites the Secretary-General to provide, before 1 July 2008, a mid-term evaluation of human resources needs, including more precise information on the needs of the various committees, as well as a detailed organisation chart of all staff (officials and other staff) working in the administration and to suggest appropriate solutions, including redeployment, in order to strengthen the core activity of legislative work;

Pour sa part, la Commission poursuivra les objectifs du présent cadre d'action au moyen des mécanismes de coordination existants, y compris les mécanismes ciblés établis par le plan d'action «mieux légiférer» (en particulier le réseau législatif réunissant tous les services législatifs de la Commission sous la coordination du Secrétariat général) et le groupe de travail interne de la Commission sur la codification.
For its part, the Commission will pursue the objectives of the present Framework for Action using the existing co-ordination mechanisms, including targeted mechanisms established in the Better Regulation Action Plan (in particular the legislative network which brings together all legislative services of the Commission under the coordination of the Secretariat General and the internal Commission working group on codification).

– (PT) Mr President, it is possible to keep track of the Council’s work by means of the monthly reports prepared by the General Secretariat of the Council and which are published on the Council’s web site, covering legislative and non-legislative acts approved since January 1999 and including the results of votes, explanations of vote and statements for the minutes when the Council is acting in its legislative capacity.
