Definition: In many cases, a disturbance of sleep is one of the symptoms of another disorder, either mental or physical. Whether a sleep disorder in a given patient is an independent condition or simply one of the features of another disorder classified elsewhere, either in this or in others, should be determined on the basis of its clinical presentation and course as well as on the therapeutic considerations and priorities at the time of the consultation. Generally, if the sleep disorder is one of the major complaints and is perceived as a condition in itself, the present code should be used along with other pertinent diagnoses describing the psychopathology and pathophysiology involved in a given case. This category includes only those sleep disorders in which emotional causes are considered to be a primary factor, and which are not due to identifiable physical disorders classified elsewhere.

IN-CONTEXT TRANSLATIONS

Le rapporteur se félicite, sur le fond, des objectifs du présent règlement, à savoir arrêter des règles juridiques pour une meilleure fixation des limites maximales de résidus de substances pharmacologiquement actives dans les denrées alimentaires d'origine animale.
The rapporteur welcomes in principle the objectives of the regulation, to simplify legislation improving how maximum residue limits (MRLs) of pharmacologically active substances in foodstuffs of animal origin are set.

Aux fins du présent pourvoi, en premier lieu, il convient de relever que le Tribunal de la fonction publique a rappelé que toute décision individuelle prise en application du statut et faisant grief doit être motivée, et que l’obligation de motivation a pour objet, d’une part, de permettre au juge d’exercer son contrôle sur la légalité de la décision et, d’autre part, de fournir à l’intéressé les indications nécessaires pour savoir si la décision est ou non fondée et lui permettre d’apprécier l’opportunité de l’introduction d’un recours. Il a néanmoins ajouté, en faisant référence à l’arrêt de la Cour du 4 juillet 1996, Parlement/Innamorati (C‑254/95 P, Rec. p. I‑3423, points 24 à 28), que, en ce qui concerne les décisions prises par un jury de concours, l’obligation de motivation doit être conciliée avec le respect du secret qui entoure les travaux du jury en vertu de l’article 6 de l’annexe III du statut, secret institué en vue de garantir l’indépendance des jurys de concours et l’objectivité de leurs travaux. Ainsi, le respect de ce secret s’oppose à la divulgation tant des attitudes prises par les membres individuels des jurys que de tous éléments ayant trait à des appréciations de caractère personnel ou comparatif concernant les candidats, et l’exigence de motivation des décisions d’un jury de concours doit tenir compte de la nature des travaux en cause, lesquels, au stade de l’examen des aptitudes des candidats, sont avant tout de nature comparative et, de ce fait, couverts par le secret inhérent à ces travaux (points 30 et 31 de l’arrêt attaqué).
For the purposes of the present appeal, it must first be stated that the Civil Service Tribunal recalled that any decision relating to a specific individual which is taken under the Staff Regulations and adversely affects that person must state the reasons on which it is based, on the one hand, to enable the competent court to review the legality of the decision and, on the other, to provide the person concerned with the information necessary to allow him to ascertain whether or not the decision is well founded and to enable him to decide whether to bring an action. It added, however, referring to Case C‑254/95 P Parliament v Innamorati [1996] ECR I‑3423, paragraphs 24 to 28, that, as far as concerns decisions taken by a selection board in a competition, the obligation to state reasons must be reconciled with observance of the secrecy surrounding the proceedings of selection boards by virtue of Article 6 of Annex III to the Staff Regulations, secrecy which was instituted with a view to guaranteeing the independence of selection boards and the objectivity of their proceedings. Thus, observance of this secrecy precludes both disclosure of the attitudes adopted by individual members of selection boards and disclosure of any factors relating to individual or comparative assessments of candidates and that the obligation to state the reasons on which decisions of a selection board in a competition are based must take account of the nature of the proceedings concerned, which, at the stage of examination of the abilities of the candidates, are primarily comparative in character and accordingly covered by the secrecy inherent in those proceedings (paragraphs 30 and 31 of the judgment under appeal).

En troisième lieu, le Tribunal de la fonction publique a observé que, quand bien même l’issue de la conciliation entre l’obligation de motivation et le respect du principe du secret des travaux du jury, en particulier sur le point de savoir si la communication d’une seule note individuelle éliminatoire au candidat éliminé lors de la phase orale satisfait à ladite obligation, penche le plus souvent en faveur du principe du secret des travaux du jury, il peut en être autrement en présence de circonstances particulières, et ce d’autant plus que la jurisprudence récente concernant le règlement (CE) n° 1049/2001 du Parlement européen et du Conseil, du 30 mai 2001, relatif à l’accès du public aux documents du Parlement européen, du Conseil et de la Commission (JO L 145, p. 43), montrerait une évolution en faveur de la transparence (voir, en ce sens, arrêts de la Cour du 18 décembre 2007, Suède/Commission, C‑64/05 P, Rec. p. I‑11389, et du 1 juillet 2008, Suède et Turco/Conseil, C‑39/05 P et C‑52/05 P, Rec. p. I-4723) (point 40 de l’arrêt attaqué).
Thirdly, the Civil Service Tribunal observes that even though the outcome of reconciling the obligation to state reasons and observance of the principle of the secrecy of the selection board’s proceedings, in particular as to whether the communication of a single eliminatory individual mark to the candidate eliminated in the oral phase satisfies that obligation, is more often than not in favour of the principle of the secrecy of the selection board’s proceedings, the position may be otherwise when special circumstances exist, all the more so as the recent case-law concerning Regulation (EC) No 1049/2001 of the European Parliament and of the Council of 30 May 2001 regarding public access to European Parliament, Council and Commission documents (OJ 2001 L 145, p. 43) shows a development of Community case-law in favour of openness (see, to that effect, Case C‑64/05 P Sweden v Commission [2007] ECR I‑11389, and Joined Cases C‑39/05 P and C‑52/05 P Sweden and Turco v Council [2008] ECR I‑4723) (paragraph 40 of the judgment under appeal).

I‑A‑339 et II‑921, point 79), des précisions complémentaires pouvaient être apportées en cours d’instance, en revanche, cette seule note n’était pas suffisante, dans les circonstances de l’espèce, pour satisfaire pleinement à l’obligation de motivation.
Fifthly, the Civil Service Tribunal held, in consequence of the existence of those special circumstances, that although the communication to the applicant of the individual eliminatory mark, of 24.5 out of 50, which he received in the oral test constitutes more than merely the initial elements of a statement of reasons which, according to the case-law (Case T‑71/96 Berlingieri Vinzek v Commission [1997] ECR-SC I‑A‑339 and II‑921, paragraph 79), was susceptible of being supplemented by further information provided during the proceedings, that mark alone not being sufficient, in the particular circumstances, to satisfy fully the obligation to state reasons.

In line with the applicable case-law, especially the judgments of 26 March 1987 (Case 45/86, Commission v. Council, ECR 1493), 11 February 1991 (Case 300/89, Commission v. Council, ECR I-1689), this amendment aims to enable Parliament to be more fully involved in the creation, development and establishment of the Joint Undertaking.

66 En effet, il ressort des première et deuxième phrases du point 42 de l’arrêt attaqué que, indépendamment de la question de savoir si les sachets tenant debout sont susceptibles d’être utilisés pour les boissons de fruits et les jus de fruits, le Tribunal a conclu au défaut de caractère distinctif des marques demandées au motif que ce mode de conditionnement est déjà utilisé dans la Communauté pour les liquides alimentaires en général et que, partant, il ne possède pas un caractère inhabituel suffisamment prononcé pour que le consommateur moyen perçoive ce conditionnement, en lui-même, comme indiquant l’origine commerciale particulière d’un produit de cette catégorie.
It is apparent from the first and second sentences of paragraph 42 of the judgment under appeal that, irrespective of whether stand-up pouches are capable of being used for fruit drinks and fruit juices, the Court of First Instance found that the trade marks applied for were devoid of any distinctive character on the ground that that form of packaging is already in general use in the Community for liquids for human consumption and that, therefore, it is not sufficiently unusual for the average consumer to perceive it, per se, as an indication of the specific commercial origin of a product within that category.

58 Par ailleurs, il résulterait du point 54 de l’arrêt attaqué que le Tribunal n’a pas fait de l’existence d’un risque de monopolisation des sachets tenant debout un critère d’application de l’article 7, paragraphe 1, sous b), du règlement n° 40/94, de sorte qu’il n’y a pas lieu de s’interroger en l’espèce sur le point de savoir si un tel risque existe vraiment.
Furthermore, it follows from paragraph 54 of the judgment under appeal that the Court of First Instance did not make the risk of creating a monopoly in stand-up pouches a criterion for application of Article 7(1)(b) of Regulation No 40/94, such that there is no need in the present case to consider whether such a risk truly exists.
