Si la gestion et le fonctionnement des services de santé relèvent de la compétence des États membres, la Communauté peut néanmoins intervenir, en complément des activités nationales, en vue d'améliorer la santé publique, de prévenir les maladies et affections humaines et de supprimer les causes de danger pour la santé humaine (article 152 du traité d'Amsterdam).
Management and operation of the health services are a Member State competence, yet there is a role for the Community complementing their activities with the aim of improving public health, preventing human illness and diseases, and obviating sources of danger to human health (Art 152 Amsterdam Treaty).

La présente proposition a des effets sur les droits et principes suivants inscrits dans la Charte des droits fondamentaux de l’Union européenne: le droit aux soins de santé (notamment à un niveau élevé de protection de la santé humaine, article 35) et de protection des consommateurs (article 38), le respect de la liberté d’entreprise (article 16), le droit de propriété (article 17), le droit à un recours effectif et à accéder à un tribunal impartial (article 47), la présomption d’innocence et les droits de la défense (article 48).
The proposal is relevant for the following rights and principles enshrined in the EU Charter of Fundamental Rights: the right to health care (notably to a high level of human health protection, Article 35) and to consumer protection (Article 38), the respect of the freedom to conduct a business (Article 16), the right to property (Article 17), the right to an effective remedy and to a fair trial (Article 47), the presumption of innocence and right to defence (Article 48).

G. whereas, pursuant to Article 6(1) of Directive 2008/98/EC, certain specified waste shall cease to be waste when it has undergone a recovery operation (including recycling) and complies with specific criteria to be developed in accordance with the conditions laid down in that article; whereas those conditions include: a) that the substance or object complies with the existing legislation and standards applicable to products (Article 6(1c)); and b): that the use of the substance or object will not lead to overall adverse environmental or human health impacts (Article 6(1d));

Alors que les paragraphes 2 et 3 de l'article 168 traitent de la coopération entre les États membres et les pays tiers ainsi que de la coordination de leurs politiques, les paragraphes 4 et 5 prévoient que le Parlement européen et le Conseil, statuant conformément à la procédure législative ordinaire, peuvent adopter des mesures particulières, notamment des mesures d'harmonisation destinées à faire face aux enjeux communs de sécurité (article 168, paragraphe 4, du traité FUE) ou des "mesures d'encouragement visant à protéger et à améliorer la santé humaine" (article 168, paragraphe 5, du traité FUE).
Whereas paragraphs 2 and 3 of Article 168 deal with cooperation and coordination between Member States and with third countries, paragraphs 4 and 5 provide for specific measures to be adopted by the European Parliament and Council under the ordinary legislative procedure, i.e. harmonisation measures in order to meet common safety concerns (Article 168(4) TFEU) and "incentive measures designed to protect and improve human health" (Article 168(5) TFEU).

In line with the Charter of Fundamental Rights of the EU, this proposal seeks to ensure a high level of human health protection (Article 35 of the Charter) and consumer protection (Article 38) by assuring a high level of safety of consumer products made available on the Union market.

Une telle nécessité peut aussi naître d’une situation d’urgence due à l’apparition d’un risque grave pour la santé humaine [article 24, point a)], dans laquelle la Commission pourrait être appelée à adopter des actes délégués au moyen de la procédure d’urgence prévue à l’article 28 de la directive.
Such a need may also arise in an emergency situation related to a new serious risk to human health (Article 24(a)) where the Commission may be required to adopt delegated acts through the urgency procedure, in accordance with Article 28 of the Directive.
