TRADUCTIONS EN CONTEXTE

110. salue les efforts, reconnus par les Nations unies, déployés pour améliorer la documentation des allégations de violations des droits de l'homme au Sahara occidental, en particulier par l'intermédiaire du Conseil national marocain des droits de l'homme (CNDH), qui dispose de bureaux à Laayoune et Dakhla; note le travail efficace du CNDH et demande au gouvernement marocain d'aider à renforcer son indépendance et sa compétence et d'assurer l'application de ses recommandations; encourage toutefois le CNDH à consentir davantage d'efforts pour établir des relations avec les Sahraouis hostiles à l'ordre marocain et pour garantir qu'un suivi adéquat soit donné aux plaintes; salue l'adoption par le Maroc en 2012 de trois des cinq recommandations du Conseil de sécurité des Nations unies sur la situation des droits de l'homme au Sahara occidental, et l'invite à adopter les deux recommandations restantes; se félicite par ailleurs des invitations marocaines aux délégations internationales ad hoc, y compris au rapporteur spécial des Nations unies sur la torture, et du fait que ces invitations aient été acceptées; invite instamment les autorités marocaines à autoriser les missions d'enquête par d'autres organisations internationales telles que la Commission africaine des droits de l'homme et des peuples et le Parlement européen; prie toutes les parties concernées de poursuivre cette coopération avec les organismes des Nations unies chargés des droits de l'homme; soutient la création d'une mission MINURSO-CICR (Comité international de la Croix Rouge) officielle dans la zone de Fadret Leguiaa afin de procéder à l'exhumation et à la restitution des dépouilles aux familles, à la suite de la découverte de fosses communes par l'équipe d'investigation de l'Université du Pays basque;
110. Welcomes efforts to improve the documentation of alleged human rights abuses in Western Sahara, in particular through the institution of the CNDH, with offices in Laayoune and Dakhla, as recognised by the UN; notes the positive work of the CNDH and calls on the Moroccan Government to help strengthen its independence and remit, and to ensure the implementation of its recommendations; encourages, moreover, the CNDH to increase its efforts to build relationships with those Sahrawis who are hostile to Moroccan rule and to guarantee adequate follow-up to complaints; welcomes Morocco’s adoption in 2012 of three of the five UN Human Rights Council recommendations on the human rights situation in Western Sahara, and calls on it to adopt the remaining two; welcomes, furthermore, Moroccan invitations to ad-hoc international delegations, including the UNSR on torture, and the fact that those invitations were accepted; urges the Moroccan authorities to give authorisation for fact-finding missions to be conducted by other international organisations, such as the African Commission on Human and Peoples’ Rights and the European Parliament; urges all relevant parties to continue such engagement with UN human rights bodies; supports the creation of an official MINURSO-ICRC mission in the area of Fadret Leguiaa in order to proceed with the exhumation and the restitution of remains to families, following the discovery of common graves by the investigation team of the University of the Basque Country;

C. considérant que, selon l'avis juridique du service juridique du Parlement européen, si les droits du peuple Sahraoui au titre du droit international ne sont pas respectés, l'Union doit envisager de suspendre l'accord conformément à son article 15 et à l'article 9 du protocole, ou bien de l'appliquer de telle façon que les navires de l'Union soient exclus de l'exploitation des eaux du Sahara occidental;
C. whereas the legal opinion of the Legal Service of the European Parliament notes that if ‘the rights’ of ‘the Saharawi people under international law’ are not respected, ‘the Community should envisage either the suspension of the agreement in conformity with its Article 15 and Article 9 of the Protocol, or to apply the agreement in such a way that EU flagged vessels are excluded from the exploitation of the waters of Western Sahara’;

Ces deux conditions préalables doivent être respectées car "si un tel accord amiable ne peut être trouvé, la Communauté doit envisager de suspendre l'accord, conformément aux articles 15 et 19 du protocole, ou de l'appliquer de telle façon que les navires de l'Union soient exclus de l'exploitation des eaux du Sahara occidental".
Both these prerequisites must be fulfilled, otherwise the EU should “envisage either the suspension of the agreement in conformity with its Article 15 and Article 19 of the Protocol, or to apply the agreement in such a way that EU flagged vessels are excluded from the exploitation of the waters of Western Sahara”.
