(e) Eu égard à l’alinéa 3(d)(2) ci-dessus, lorsqu’une demande de réparation en subrogation du Gouvernement du Japon ne repose pas sur la législation en matière d’indemnisation des employés gouvernementaux en cas d’accident, le Gouvernement du Japon s’acquitte de son obligation à renoncer à ses demandes de réparation en subrogation en s’assurant que l’entité auxiliaire désignée conformément à l’alinéa 2(a) ci-dessus dédommage, dans le respect de l’article 15.2 et de la législation et réglementation en vigueur au Japon, toute entité ou personne énumérée aux alinéas 3(a)(1) à 3(a)(3) ci-dessus pour les responsabilités découlant des demandes de réparation en subrogation du Gouvernement du Japon.
(e) With respect to subparagraph 3(d)(2) above, in the event that a subrogated claim of the Government of Japan is not based upon government employee accident compensation law, the Government of Japan shall fulfill its obligation to waive such subrogated claim by ensuring that any assisting entity specified pursuant to subparagraph 2(a) above indemnifies, in a manner consistent with Article 15(2) and in accordance with applicable laws and regulations of Japan, any entity or person identified in subparagraphs 3(a)(1) through 3(a)(3) above against liability arising from such subrogated claim by the Government of Japan.
