IN-CONTEXT TRANSLATIONS

Les lignes directrices et communications adoptées par la Commission en ce qui concerne l'évaluation du respect des règles de l'Union en matière d'aides d'État lors de la restructuration d'entreprises en difficulté du secteur financier, conformément à l'article 107, paragraphe 3, du traité, peuvent constituer une référence utile pour l'élaboration du plan de réorganisation des activités, même lorsque aucune aide d'État n'a été octroyée, car elles partagent avec ce dernier l'objectif de rétablir la viabilité à long terme de l'établissement ou de l'entité.
The guidelines and communications adopted by the Commission in relation to the assessment of compliance with the Union State aid framework relating to the restructuring of firms in difficulties in the financial sector, pursuant to Article 107(3) of the Treaty, may provide useful reference for the elaboration of the business reorganisation plan even where no State aid has been granted, since they share with the business reorganisation plan the objective of restoring the institution or entity's long-term viability.

Moreover, in the case of Pickman, it appears that (i) the restructuring plan is not expected to lead to an increase in capacity; (ii) the company’s workforce will be reorganised, with downsizing taking place at certain plants and investment being made in the commercial and IT areas; (iii) Pickman is small, meaning that it can avail itself of aid; (iv) the company’s potential presence in the market is very limited and was even more limited in 2003, as compared to its competitors (see the market study referred to above); and (v) according to the Spanish regional aid map for the period 2000-2006 (15), Andalusia was a NUTS II area and, on the basis of its per capita GDP/PPS of below 60 % by comparison with the Community average, qualified under Article 87(3)(a) of the EC Treaty.
