67. With regard to the breach of Article 27(2) of the Rules Governing the Payment of Expenses and Allowances, the applicant observes that, as a result of his letter of 21 April 2003 (see paragraph 43 above), in which he had pointed out that the Rules Governing the Payment of Expenses and Allowances had been incorrectly applied in his regard, and given that no agreement had been reached between the Secretary-General and himself, the matter should have been referred to the Quaestors in accordance with that article for them to take a decision after consulting the Secretary-General and, where appropriate, the President or the Bureau.

93 Le Parlement a, en outre, affirmé lors de l’audience, en répondant à une question orale, que le bureau, en adoptant l’article 27, paragraphe 4, de la réglementation FID, avait l’intention de créer une règle spéciale par rapport à celle contenue au paragraphe 3 du même article, assortie de certaines garanties procédurales en faveur du député dont la dette est recouvrée par voie de compensation.

In reply to an oral question, the Parliament also asserted at the hearing that by adopting Article 27(4) of the Rules Governing the Payment of Expenses and Allowances the Bureau intended to create a special rule vis-à-vis that contained in paragraph 3 of the same article, affording certain procedural guarantees to a Member whose debt is recovered by offsetting.

103 S’agissant, enfin, de la branche du présent moyen concernant la violation de l’article 27, paragraphe 3, de la réglementation FID, selon laquelle le secrétaire général avait, sans avoir consulté les questeurs au préalable, acquis la certitude, dès sa décision du 26 février 2003, que la somme de 176 516 euros avait été indûment versée (voir point 70 ci-dessus), celle-ci doit être rejetée comme irrecevable en vertu de l’article 44, paragraphe 1, sous c), et de l’article 48, paragraphe 2, premier alinéa, du règlement de procédure du Tribunal.
103. Lastly, the part of the present plea concerning the breach of Article 27(3) of the Rules Governing the Payment of Expenses and Allowances – according to which the Secretary-General was satisfied, without having previously consulted the Quaestors, as from the date of his decision of 26 February 2003 that the sum of EUR 176 516 had been improperly paid (see paragraph 70 above) – must be dismissed as inadmissible under Article 44(1)(c) and the first subparagraph of Article 48(2) of the Rules of Procedure of the Court of First Instance.

70 S’agissant de la violation de l’article 27, paragraphe 3, de la réglementation FID, le requérant considère que, contrairement à ce qu’impose cette disposition, le secrétaire général avait, sans avoir consulté les questeurs au préalable, acquis la certitude, dès sa décision du 26 février 2003 (voir point 41 ci-dessus), que la somme de 176 516 euros avait été indûment versée.
70. With regard to the breach of Article 27(3) of the Rules Governing the Payment of Expenses and Allowances, the applicant considers that, contrary to the requirements of that provision, the Secretary-General was satisfied, without having previously consulted the Quaestors, as from the date of his decision of 26 February 2003 (see paragraph 41 above) that the sum of EUR 176 516 had been improperly paid.

77 Pour ce qui est de la lettre du requérant du 21 avril 2003 (voir point 67 ci-dessus), le Parlement fait observer qu’elle ne pouvait avoir déclenché la procédure de l’article 27, paragraphe 2, de la réglementation FID, puisque le secrétaire général n’avait pas encore, à ce moment, statué définitivement.
77. With regard to the applicant’s letter of 21 April 2003 (see paragraph 67 above), the Parliament observes that the letter could not have triggered the procedure under Article 27(2) of the Rules Governing the Payment of Expenses and Allowances, as at that time the Secretary-General had not reached a final decision.
