Le principe suivi est que la réglementation communautaire définit un socle commun de conditions minimales auxquelles tous les systèmes de gestion et de contrôle interne impliqués dans la gestion des Fonds communautaires doivent en tout état de cause se conformer, et qu'elle permette en même temps aux Etats membres d'appliquer leur propres règles et structures de gestion et de contrôle lorsque les taux de co-financement nationaux sont largement prépondérants et que le volume de la contribution communautaire soit inférieur à un seuil déterminé.
The principle followed is that the Community rules lay down a common threshold of minimum conditions to which all management and internal control systems involved in the management of the Community Funds must conform in any event, while at the same time it allows the Member States to apply their own rules and management and inspection structures where part-financing is mainly national and the Community contribution is below a certain threshold.

2. With due regard to Community law, a trademark the use of which corresponds to one of the situations referred to in Article 13 which has been applied for, registered, or established by use, if that possibility is provided for by the legislation concerned, in good faith within the territory of the Community, before either the date of protection of the designation of origin or geographical indication in the country of origin or before 1 January 1996, may continue to be used notwithstanding the registration of a designation of origin or geographical indication, provided that no grounds for its invalidity or revocation exist as specified by First Council Directive 89/104/EEC of 21 December 1988 to approximate the laws of the Member States relating to trade marks (8) or Council Regulation (EC) No 40/94 of 20 December 1993 on the Community trade mark (9).
