3 ter. Toute décision de refuser la mise sur le marché, l'immatriculation ou la mise en service d'un véhicule pour lequel une réception individuelle a été accordée par l'autorité compétente d'un autre État membre doit faire l'objet d'une notification écrite à la personne concernée et à la Commission dans un délai de 20 jours ouvrables à compter de la date d'expiration du délai de réception des observations visé au paragraphe 3 bis. La décision tient dûment compte desdites observations et elle précise les motifs sur lesquels elle repose, y compris ceux qui motivent, le cas échéant, le rejet des arguments avancés par la personne concernée, ainsi que les éléments techniques ou scientifiques visés au paragraphe 1 du présent article.
3b. Any decision to refuse the placing on the market, registration or entry into service of a vehicle which has been granted an individual approval by an approval authority from another Member State shall be notified in writing to the person concerned and to the Commission within a period of 20 working days from the expiry of the time limit for the receipt of comments set in accordance with paragraph 3a. It shall take due account of those comments and shall state the grounds on which it is based, including the reasons for rejecting the arguments, if any, put forward by the person concerned, and the technical or scientific evidence as referred to in paragraph 1 of this Article.

3. Where a particular vehicle covered by an individual approval has to be registered in another Member State, that Member State may require, from the approval authority that has issued the individual approval, any additional information stating in detail the nature of the technical requirements satisfied by that particular vehicle.

Four principles must be observed: - whatever the technical specifications of the satellite whereby individual reception is possible, satellite broadcasting of a programme must be subject to authorization by the person holding the rights to that programme; - a broadcaster wishing to transmit a programme by satellite must acquire the rights to that programme from the holder of those rights in the country in which he is established; - as all holders of rights must be guaranteed an equivalent level of protection throughout the Community, it is essential that copyright and associated rights are managed on a contractual basis; - the fee to be paid must take account of the potential or actual audience within the satellite "footprint".
