S’agissant plus particulièrement d’une décision de réaffectation d’un fonctionnaire, nonobstant le fait qu’elle ne constitue pas un rapport concernant la compétence, le rendement ou le comportement du fonctionnaire concerné, au sens de l’article 26 du statut, cette communication et ce classement dans le dossier individuel s’imposent, a priori, pour des courriels ou une note signée par des fonctionnaires et agents dénonçant l’attitude du fonctionnaire en question, dès lors qu’ils sont susceptibles d’exercer une influence déterminante sur la décision de le réaffecter ou non.
As regards more particularly a decision reassigning an official, despite the fact that it does not constitute a report relating to his ability, efficiency or conduct within the meaning of Article 26, emails or a note signed by officials and other staff criticising the attitude of the official in question must first be communicated to him and placed on his personal file, since they are capable of having a decisive influence on the decision whether or not to reassign him.

However, decisions to reassign are subject, like transfers, as regards the protection of the rights and legitimate interests of the official concerned, to the rules of Article 7(1) of the Staff Regulations inasmuch as, inter alia, the reassignment of officials may take place only in the interests of the service and in conformity with the principle of equivalence of posts.

In the event of a change in an official’s duties upon reassignment, the principle that the post to which an official is assigned should correspond to his grade, set out in Article 7 of the Staff Regulations in particular, calls for a comparison, not between his present and previous duties, but between his present duties and his grade.
