The Commission should be empowered to adopt delegated acts in accordance with Article 290 TFEU in order to determine the rules for the calculation of the interest rate to be applied in the event of a decision on the recovery of misused amounts from the Fund and to guarantee the rights to good administration and of access to documents of beneficiaries in procedures in respect of such a recovery; determine the type of contributions to the Fund and the matters for which contributions are due, and the manner in which the amount of the contributions is calculated and the way in which they are to be paid; specify registration, accounting, reporting and other rules necessary to ensure that the contributions are paid fully and in a timely manner; determine the annual contributions necessary to cover the administrative expenditure of the Board before it becomes fully operational; determine the contribution system for institutions that have been authorised to operate after the Fund has reached its target level; determine the criteria for the spreading out in time of the contributions; determine the criteria for determining the number of years by which the initial period for reaching the target level can be extended; determine the criteria for establishing the annual contributions when the available financial means of the Fund diminishes below its target level after the initial period; determine the measures to specify the circumstances and conditions under which ex-post contributions may be temporarily deferred for individual institutions; and determine the detailed rules for the administration of the Fund and general principles and criteria for its investment strategy.

In order to ensure that the necessary rules for the proper functioning of the identification, registration and traceability of bovine animals and of beef are applied, the power to adopt acts in accordance with Article 290 TFEU should be delegated to the Commission in respect of the requirements for alternative means of identification of bovine animals; the special circumstances in which Member States are to be permitted to extend the maximum periods for the application of the means of identification; data to be exchanged between the computerised databases of the Member States; the maximum period for certain reporting obligations; the requirements for the means of identification; the addition of means of identification to the list set out in Annex I; the rules concerning the information from the computerised database to be included in the animal passports and in the individual registers to be kept on each holding; the identification and registration of movements of bovine animals when put out to seasonal grazing including transhumance; rules for labelling certain products which should be equivalent to the rules laid down in Regulation (EC) No 1760/2000; the labelling provisions relating to a simplified presentation of the indication of origin for cases of very short stay of an animal in the Member State or third country of birth or of slaughter; and the definitions and requirements applicable to terms or categories of terms that may be put on the labels of pre-packed fresh and frozen beef and veal.

(23) Pour garantir l'uniformité des conditions d'application du règlement (CE) n° 1760/2000 en ce qui concerne l'enregistrement des exploitations ayant recours à d'autres moyens d'identification, les caractéristiques techniques et les modalités de l'échange de données entre les bases de données informatisées des États membres, la déclaration du fait que le système d'échange de données entre États membres est pleinement opérationnel, la présentation et la conception des moyens d'identification, les procédures et normes techniques nécessaires à la mise en place de l'identification électronique, la présentation des passeports et du registre devant être tenu dans chaque exploitation, les règles définissant les modalités d'application des sanctions imposées par les États membres aux exploitants en vertu du règlement (CE) n° 1760/2000, les mesures correctrices que les États membres doivent prendre pour assurer la bonne observation du règlement (CE) n° 1760/2000 lorsque des contrôles sur place le justifient, ainsi que les règles nécessaires pour s'assurer de la bonne observation des dispositions afférentes en particulier aux contrôles, aux sanctions administratives et à divers délais maximaux prévus au présent règlement, il convient que des compétences d'exécution soient conférées à la Commission.
(23) In order to ensure uniform conditions for the implementation of Regulation (EC) No 1760/2000 with respect to the registration of holdings making use of alternative means of identification, technical characteristics and modalities for the exchange of data between the computerised databases of Member States, the declaration that the data exchange system between Member States is fully operational, the format and design of the means of identification, technical procedures and standards for the implementation of EID, the format of the passports and of the register to be kept on each holding, rules concerning the modalities for the application of the sanctions imposed by the Member States on holders pursuant to Regulation (EC) No 1760/2000, corrective actions to be taken by the Member States to ensure proper compliance with Regulation (EC) No 1760/2000, in cases where on-the-spot checks so justify, and the necessary rules to ensure proper compliance in particular as regards controls, administrative sanctions, and various maximum periods laid down in this Regulation, implementing powers should be conferred on the Commission.

(17) This Directive does not seek to harmonise national rules concerning contract law, particularly the formation and performance of contracts, or other formalities of a non-contractual nature concerning signatures; for this reason the provisions concerning the legal effect of electronic signatures should be without prejudice to requirements regarding form laid down in national law with regard to the conclusion of contracts or the rules determining where a contract is concluded;
