(3) Les frais prévus pour l’examen d’une demande visée aux articles 295, 301 ou 307 du Règlement sur l’immigration et la protection des réfugiés, dans leur version antérieure à l’entrée en vigueur du présent règlement, sont applicables à l’égard de l’enfant à charge d’une personne visée au paragraphe (1) qui est âgé de vingt-deux ans ou plus ou, s’il est âgé de moins de vingt-deux ans, est un époux ou conjoint de fait et qui est visé au sous-alinéa b)(ii) de la définition de « enfant à charge » à l’article 2 du Règlement sur l’immigration et la protection des réfugiés, dans sa version antérieure à l’entrée en vigueur du présent règlement.
(3) The fees payable for processing an application referred to in sections 295, 301 and 307 of the Immigration and Refugee Protection Regulations, as they read immediately before the coming into force of these Regulations, shall apply to a dependent child of a person referred to in subsection (1) if that child is 22 years of age or older — or, if less than 22 years of age, is a spouse or common-law partner — and meets the description set out in subparagraph (b)(ii) of the definition of “dependent child” in section 2 of those Regulations as it read immediately before the coming into force of these Regulations.

Article 4(3) of the ‘Consolidated text of provisions governing immigration and the status of aliens’ No 286 of 28 July 1998 states that Italy, in accordance with the obligations entered into by adherence to specific international agreements, shall allow entry into its territory to aliens who can prove that they possess suitable documentation to confirm the purpose and conditions of their residence and that they have sufficient means of subsistence for the duration of their stay and, except in the case of residence permits for work purposes, for their return to the country of origin.

According to the Aliens and Immigration Regulations (Regulation (9(2)(B)) the entry of aliens for temporary stay in the Republic depends on the discretionary power of the immigration officers at the borders, which is exercised according to the general or specific instructions of the Minister of Interior or to the provisions of the abovementioned Regulations.

In accordance with Article 6 paragraph 1 of Council Regulation (EC) No 377/2004 of 19 February 2004 on the creation of an immigration liaison officers network (hereinafter: Regulation) ‘The Member State holding the Presidency of the Council of the European Union or, if this Member State is not represented in the country or region, the Member State serving as acting Presidency shall draw up by the end of each semester a report on the activities of immigration liaison officers networks in which it has a representative, as well as on the situation in the host country, in matters relating to illegal immigration to the Council and the Commission’.

In this Regulation "immigration liaison officer" means a representative of one of the Member States, posted abroad by the immigration service or other competent authorities in order to establish and maintain contacts with the authorities of the host country with a view to contributing to the prevention and combating of illegal immigration, the return of illegal immigrants and the management of legal migration.
