TRADUCTIONS EN CONTEXTE

Par décision du 23 décembre 2013, portant référence MSPH 98 INS 36628/2013-A-11, le Městský soud v Praze (cour municipale de Prague) a, en vertu du droit tchèque et plus précisément de la loi no 182/2006 Rec. relative aux faillites et à leurs modes de règlement (loi sur l’insolvabilité) telle que modifiée, constaté la faillite du débiteur Metropolitní spořitelní družstvo «v likvidaci», sis à Sokolovská 394/17, 180 00 Praha 8, République tchèque, no d’immatriculation 25571150 (ci-après dénommé le «débiteur»). La juridiction a, par la même occasion, prononcé la liquidation des biens du débiteur.
By decision of the Prague City Court of 23 December 2013, reference number MSPH 98 INS 36628/2013-A-11, under Czech law, namely Act No 182/2006 on insolvency and procedures for handling it (the Insolvency Act), as amended, the debtor Metropolitní spořitelní družstvo v likvidaci (‘Metropolitan Savings Association — in liquidation’), having its registered address at Sokolovská 394/17, 180 00 Praha 8, Czech Republic, ID No 25571150, was declared insolvent and an insolvency order issued against its assets.

Where an agreement on the choice of law has been concluded prior to [date of application of this Regulation] in anticipation of the possibility of choosing the law provided for in this Regulation, but that agreement was not valid under the law applicable in accordance with the relevant rules of private international law at the time when the agreement on the choice of law was concluded because no possibility of making a choice of law for registered partnerships existed under the applicable law, that agreement shall be valid as from [date of application of this Regulation].

(18) Afin de faciliter la gestion des biens des partenaires, le présent règlement les autorise à choisir la loi applicable à l'ensemble des biens couverts par leur régime patrimonial, quelle que soit la nature ou localisation de ces biens; soit la loi de l'État d'enregistrement du partenariat, soit la loi de l'État avec lequel les partenaires entretiennent des liens étroits du fait qu'ils y ont leur résidence ou en raison de leur nationalité, sous réserve que ce soit la loi d'un État qui reconnaisse l'institution du partenariat enregistré même si cette loi n'est pas la loi d'un État membre.
(18) To facilitate the partners' management of their property, this Regulation authorises them to choose as the law applicable to all the property covered by their property regime, regardless of the nature or location of that property, either the law of the State where the partnership was registered or the law of the State with which the partners have close links by virtue of residence or on account of their nationality, as long as it is the law of a State that recognises the institution of registered partnerships, even if this law is not the law of a Member State.

In a situation involving a conflict of laws, where the law applicable to the sales or service contract is determined in accordance with Article 6(1) and (2) of Regulation (EC) No 593/2008 of the European Parliament and of the Council of 17 June 2008 on the law applicable to contractual obligations (Rome I) (9), the solution imposed by the ADR entity should not result in the consumer being deprived of the protection afforded to him by the provisions that cannot be derogated from by agreement by virtue of the law of the Member State in which the consumer is habitually resident.

Le présent règlement devrait présenter un caractère universel, c’est-à-dire qu’il devrait être possible, en ce qui concerne ses règles uniformes de conflit de lois, de désigner la loi d’un État membre participant, la loi d’un État membre non participant, ou la loi d’un État non membre de l’Union européenne.
This Regulation should be universal, i.e. it should be possible for its uniform conflict-of-laws rules to designate the law of a participating Member State, the law of a non-participating Member State or the law of a State which is not a member of the European Union.

À défaut de choix de la loi applicable, le présent règlement devrait instaurer des règles de conflit de lois harmonisées sur la base d’une échelle de critères de rattachement successifs fondés sur l’existence d’un lien étroit entre les époux et la loi concernée, en vue de garantir la sécurité juridique et la prévisibilité et d’empêcher une situation dans laquelle l’un des époux demande le divorce avant l’autre pour faire en sorte que la procédure soit soumise à une loi donnée qu’il estime plus favorable à ses propres intérêts.
Where no applicable law is chosen, and with a view to guaranteeing legal certainty and predictability and preventing a situation from arising in which one of the spouses applies for divorce before the other one does in order to ensure that the proceeding is governed by a given law which he considers more favourable to his own interests, this Regulation should introduce harmonised conflict-of-laws rules on the basis of a scale of successive connecting factors based on the existence of a close connection between the spouses and the law concerned.

(7 bis) Le souci de cohérence du droit communautaire commande que le présent règlement n'affecte pas les dispositions relatives à la loi applicable ou qui ont une incidence sur la loi applicable contenues dans les instruments de droit dérivé autre que le règlement, tels que les règles de conflit de lois dans des matières particulières, les lois de police d'origine communautaire et les principes juridiques fondamentaux propres au marché intérieur.
(7a) The concern for consistency in Community law requires that this Regulation be without prejudice to provisions relating to or having an effect on the applicable law, contained in instruments of secondary legislation other than this Regulation, such as conflict rules in specific matters, overriding mandatory rules of Community origin, and the basic legal principles of the internal market.
