IN-CONTEXT TRANSLATIONS

La Commission prendra les mesures nécessaires pour que, lors de la mise en œuvre des mesures financées au titre du règlement, les intérêts financiers de l'Union soient protégés par l'application de mesures préventives contre la fraude, la corruption et toute autre activité illégale. Des contrôles efficaces seront réalisés et, en cas d'irrégularités, les montants indûment versés seront récupérés. Les irrégularités feront également l'objet, si nécessaire, de sanctions efficaces, proportionnées et dissuasives, conformément à l'article 325 du traité sur le fonctionnement de l'Union européenne, au règlement (CE) n° 2988/95 du Conseil relatif à la protection des intérêts financiers des Communautés européennes et au titre IV du règlement financier applicable au budget général de l'Union.
The Commission shall take appropriate measures ensuring that, when actions financed under this Regulation are implemented, the financial interests of the Union are protected by the application of preventive measures against fraud, corruption and any other illegal activities, by the performance of effective checks and, if irregularities are detected, by the recovery of the amounts wrongly paid as well as, where appropriate, by effective, proportional and deterrent penalties, in accordance with Article 325 of the Treaty on the Functioning of the European Union, with Council Regulation (EC) No 2988/95 on the protection of the European Communities’ financial interests, and with title IV of the Financial Regulation applicable to the general budget of the Union.

2. Pour les opérations impliquant un soutien des programmes aux instruments financiers au titre du FEDER, du FSE, du Fonds de cohésion et du FEAMP, les autorités de contrôle veillent à ce que les instruments financiers soient contrôlés tout au long de la période de programmation jusqu'à la clôture, tant dans le cadre des audits des systèmes que de celui des audits des opérations conformément à l'article 127, paragraphe 1, du règlement (UE) no 1303/2013.

For operations involving support from programmes to financial instruments under the ERDF, the ESF, the Cohesion Fund and the EMFF, the audit authorities shall ensure that financial instruments are audited throughout the programming period until closure both in the framework of systems audits and audits of operations in accordance with Article 127(1) of Regulation (EU) No 1303/2013.

It is necessary that financial conglomerates are identified throughout the Union according to the extent to which they are exposed to group risks, on the basis of common guidelines to be issued by the European Supervisory Authority (European Banking Authority) established by Regulation (EU) No 1093/2010 of the European Parliament and of the Council (EBA), the European Supervisory Authority (European Insurance and Occupational Pensions Authority) established by Regulation (EU) No 1094/2010 of the European Parliament and of the Council (EIOPA) and the European Supervisory Authority (European Securities and Markets Authority) established by Regulation (EU) No 1095/2010 of the European Parliament and of the Council (ESMA) in accordance with Article 56 of Regulation (EU) No 1093/2010, of Regulation (EU) No 1094/2010 and of Regulation (EU) No 1095/2010, through the Joint Committee of the European Supervisory Authorities (Joint Committee).

Is concerned at the complexity of EU financial regulations and guidelines for European financial instruments, in particular when European funds and programmes are used to support individual enterprises through the provision of relatively small amounts of funding; considers that the expense in terms of time and money involved in complying with these regulations is out of all proportion to the benefits for the final recipient of the funding; calls for streamlined management, administrative and reporting efficiency and cost-effectiveness in connection with innovative financial instruments; insists that banks, intermediaries and beneficiaries must not be discouraged or deterred from using programmes and funds by the administrative burdens involved; asks the Commission to propose simplified and less costly regulations and guidelines, especially for programmes intended to support low-volume SME finance in the form of guarantees and mezzanine or equity instruments;

Il importe également que les dispositions de ce règlement financier soient respectées, en particulier en ce qui concerne les principes d'économie, d'efficience et d'efficacité qui y sont énoncés.
It is also important that the rules of that Regulation have been met, in particular regarding the principles of economy, efficiency and effectiveness laid down therein.

Dans un souci de clarté juridique, il convient que les exceptions à la règle du non-profit, énoncées actuellement dans les modalités d'exécution, soient intégrées dans le règlement financier.
For reasons of legal clarity, the exceptions to the non-profit rule which are currently provided for in the implementing rules should be included in the Financial Regulation.

(9) Il est dans l'intérêt général européen au sens de l'article 108, paragraphe 1, point b), du règlement (CE, Euratom) n° 1605/2002 du Conseil du 25 juin 2002 portant règlement financier applicable au budget général des Communautés européennes(5), ci-après dénommé "le règlement financier", que la santé, la sécurité et les intérêts économiques des consommateurs, ainsi que les intérêts des consommateurs en matière d'élaboration de normes pour les produits et les services soient représentés au niveau communautaire.
(9) It is of general European interest within the meaning of Article 108(1)(b) of Council Regulation (EC, Euratom) No 1605/2002 of 25 June 2002 on the Financial Regulation applicable to the general budget of the European Communities(5), hereinafter referred to as "the Financial Regulation", that the health, safety and economic interests of consumers, as well as consumer interests in the development of standards for products and services, be represented at Community level.
