L’agrément relatif à l’exploitation d’un marché réglementé devrait couvrir toute activité ayant directement trait à l’affichage, au traitement, à l’exécution, à la confirmation et à la notification des ordres, à partir du moment où ils sont reçus par le marché réglementé et jusqu’au moment où ils sont transmis pour dénouement subséquent, ainsi que toute activité afférente à l’admission d’instruments financiers à la négociation.
The authorisation to operate a regulated market should extend to all activities which are directly relating to the display, processing, execution, confirmation and reporting of orders from the point at which such orders are received by the regulated market to the point at which they are transmitted for subsequent finalisation, and to activities relating to the admission of financial instruments to trading.

4. Conformément à l'article 140, paragraphe 6, du règlement financier, les remboursements annuels générés par un instrument financier donné sont attribués à cet instrument financier jusqu'au 1er janvier 2024, tandis que les recettes sont inscrites au budget général de l'Union après déduction des coûts et frais de gestion.

In accordance with Article 140(6) of the Financial Regulation, annual repayments generated by one financial instrument shall be assigned to that financial instrument until 1 January 2024, while revenues shall be entered in the general budget of the Union after deduction of management costs and fees.

First, as regards the making available again of decommitted appropriations corresponding to commitments made during the 2000 to 2006 Structural Funds programming period, the case of force majeure should continue to be applied as provided currently in the Financial Regulation until the closure of the assistance. This is in order to avoid disruption of the current system since force majeure is treated differently in Regulation (EC) No 1083/2006 of 11 July 2006 laying down general provisions on the European Regional Development Fund, the European Social Fund and the Cohesion Fund (10).

(52a) Transitional provisions should be added. This is in order to avoid disruption of the current system since force majeure is treated differently in the new Regulation governing the Structural Funds. Second, in Article 181(2), to deal with the implementation of the provisions on the central database for exclusion from participation in procurement and grant procedures. Finally, in Article 181(3) to deal with the outstanding Community commitments to be financially settled in order to close the assistance provided for in the Regulations governing the Structural Funds and the Cohesion Fund for the 2000-2006 programming period.

Aux fins de l'application de l'article 101 du règlement financier général, l'appel d'offres prévoit que l'agence peut, jusqu'à la signature du contrat, soit renoncer au marché, soit annuler la procédure de passation du marché sans que les candidats ou les soumissionnaires puissent prétendre à une quelconque indemnisation.

For the application of Article 101 of the general Financial Regulation, the call for tender shall provide that the agency may, before the contract is signed, either abandon the procurement or cancel the award procedure without the candidates or tenderers being entitled to claim any compensation.

Je voudrais souligner ici qu'il a été précisé dans le nouveau règlement financier qu'il y aurait un délai de transition jusqu'à l'exercice 2005 pour la clôture des comptes, c'est-à-dire que, jusqu'en 2005, la clôture des comptes se fera suivant la procédure fixée par l'actuel règlement financier.
I will point out now that it was made clear in the new financial regulation that there will be a transitional period up to the 2005 financial year for the clearance of accounts, meaning that, until 2005, the clearance of accounts shall follow the procedure laid down in the financial regulation as at present valid.

- (PT) Monsieur le Président, je voudrais profiter de cette minute afin de féliciter le rapporteur pour le travail magnifique qu’il a réalisé jusqu’à aujourd’hui, travail qui nous laisse un héritage extrêmement positif, mais qui l’engage aussi pour l’avenir et exige de lui qu’il apporte une réponse aussi efficace dans l’application de ce règlement, notamment dans tout ce qui concerne le système comptable qui sera appliqué, que la réponse fournie dans le cas du règlement financier.
– (PT) Mr President, I wish to use this minute to congratulate the rapporteur on the magnificent work he has produced to date, which leaves us an extremely positive legacy, but which also commits him to the future and requires him, in the implementation of this regulation and specifically in all aspects concerning the accounting system that will be implemented, to respond as effectively as he has done in the case of the Financial Regulation.
