Notes that the Joint Undertaking has not amended its financial rules in order to reflect the changes brought by the new Financial Regulation and the framework financial regulation for the bodies referred to in Article 208 of the new Financial Regulation; acknowledges from the Joint Undertaking that it assessed the changes and proposed the amendments to its Governing Board; notes that in accordance with Article 5 of Council Decision 2007/198/Euratom, the Commission is to issue an opinion prior to submission of the final version of the financial rules to the Joint Undertaking’s Governing Board; calls on the Commission and the Joint Undertaking to remedy this issue without delay;

(4) Quatre actions préparatoires ont été mises en place à cette fin dans le cadre des procédures budgétaires 2007 et 2008, afin d'engager cette coopération renforcée conformément à l'article 49, paragraphe 6, point b), du règlement (CE, Euratom) n° 1605/2002 du Conseil du 25 juin 2002 portant règlement financier applicable au budget général des Communautés européennes (le règlement financier). (4) For that purpose, four Preparatory Actions were set up in the 2007 and 2008 budget procedures to initiate such enhanced cooperation in accordance with point (b) of Article 49(6) of Council Regulation (EC, Euratom) No 1605/2002 of 25 June 2002 on the Financial Regulation applicable to the general budget of the European Communities (the Financial Regulation): business and scientific exchanges with India; business and scientific exchanges with China; cooperation with middle-income group countries in Asia; and cooperation with middle-income group countries in Latin America.

This part of the Union financial contribution should be managed under indirect centralised management in accordance with Articles 54(2)(c) and 56 of Council Regulation (EC, Euratom) No 1605/2002 of 25 June 2002 on the Financial Regulation applicable to the general budget of the European Communities (8) (Financial Regulation), and Articles 35, 38(2) and 41 of Commission Regulation (EC, Euratom) No 2342/2002 of 23 December 2002 laying down detailed rules for the implementation of Council Regulation (EC, Euratom) No 1605/2002 on the Financial Regulation applicable to the general budget of the European Communities (9).

They may depart from the rules laid down in Commission Regulation (EC, Euratom) No 2343/2002 of 23 December 2002 on the framework Financial Regulation for the bodies referred to in Article 185 of the Financial Regulation (11) where the specific operating needs of the Joint Undertaking so require and subject to prior consent of the Commission.

Malgré cette large autonomie, l'article 185 du règlement financier de l'UE (ci-après dénommé RF) prévoit que la Commission doit arrêter un règlement financier-cadre des organismes en question. Despite this high degree of autonomy, Article 185 of the EU Financial Regulation (hereinafter referred to as the FR) lays down that the Commission must adopt a framework financial regulation for these bodies, given that they are financed by means of Community funds allocated in the general budget of the European Union.
