Underlines that investing in effective transport infrastructure has a key role for Europe to defend its competitiveness and pave the way for post crisis, long term economic growth; believes that the Trans-European transport networks (TEN-T) are vital in order to guarantee the proper functioning of the internal market and provide important EAV as they contribute to improving accessibility and interoperability between the various parts of the EU by guaranteeing cross-border links and eliminating bottlenecks, improving the use of traffic management and information systems, as well as assuring intermodality in cross-border infrastructure, which the Member States alone would not invest in; considers that the TEN-T should provide a genuine European core network rather than the aggregation of national projects and that the financing of core projects should be assessed and reviewed in the light of progress on the ground and EAV; strongly believes that TEN-T should, accordingly, be a key priority in the next MFF;

Considers that the Trans-European Transport Network (TEN-T) Programme, as a means to ensure the efficient transport of people and resources, is a cornerstone of the Union's economy and a significant boost for the creation of employment and the global competitiveness of the EU as it moves out of recession. This strongly calls for a significant increase in funding and ambition for the TEN-T Programme. Without further delay, agreed TEN-T projects need to be proceeded with. The European Commission should call upon Member States to fulfil their obligations in this respect;

Aux fins du présent pourvoi, en premier lieu, il convient de relever que le Tribunal de la fonction publique a rappelé que toute décision individuelle prise en application du statut et faisant grief doit être motivée, et que l’obligation de motivation a pour objet, d’une part, de permettre au juge d’exercer son contrôle sur la légalité de la décision et, d’autre part, de fournir à l’intéressé les indications nécessaires pour savoir si la décision est ou non fondée et lui permettre d’apprécier l’opportunité de l’introduction d’un recours. Il a néanmoins ajouté, en faisant référence à l’arrêt de la Cour du 4 juillet 1996, Parlement/Innamorati (C‑254/95 P, Rec. p. I‑3423, points 24 à 28), que, en ce qui concerne les décisions prises par un jury de concours, l’obligation de motivation doit être conciliée avec le respect du secret qui entoure les travaux du jury en vertu de l’article 6 de l’annexe III du statut, secret institué en vue de garantir l’indépendance des jurys de concours et l’objectivité de leurs travaux. For the purposes of the present appeal, it must first be stated that the Civil Service Tribunal recalled that any decision relating to a specific individual which is taken under the Staff Regulations and adversely affects that person must state the reasons on which it is based, on the one hand, to enable the competent court to review the legality of the decision and, on the other, to provide the person concerned with the information necessary to allow him to ascertain whether or not the decision is well founded and to enable him to decide whether to bring an action. It added, however, referring to Case C‑254/95 P Parliament v Innamorati [1996] ECR I‑3423, paragraphs 24 to 28, that, as far as concerns decisions taken by a selection board in a competition, the obligation to state reasons must be reconciled with observance of the secrecy surrounding the proceedings of selection boards by virtue of Article 6 of Annex III to the Staff Regulations, secrecy which was instituted with a view to guaranteeing the independence of selection boards and the objectivity of their proceedings. Thus, observance of this secrecy precludes both disclosure of the attitudes adopted by individual members of selection boards and disclosure of any factors relating to individual or comparative assessments of candidates and that the obligation to state the reasons on which decisions of a selection board in a competition are based must take account of the nature of the proceedings concerned, which, at the stage of examination of the abilities of the candidates, are primarily comparative in character and accordingly covered by the secrecy inherent in those proceedings (paragraphs 30 and 31 of the judgment under appeal).

Agrees therefore to develop a more coherent and integrated network approach, reflecting the needs for intermodal connections for citizens and freight; emphasises therefore that priority must be given to rail, ports, sustainable maritime and inland waterways and their hinterland connections or intermodal nodes in infrastructure links with and within new Member States and that particular attention must also be paid to cross-border transport links, as well as to better links with airports and sea ports in the trans-European networks; emphasises that attention should be paid to the different but complementary needs of both passengers and freight; recommends that Member States and regional authorities improve intermediate stations and local interconnections as links to TEN-T in order to minimise the costs associated with being in a peripheral area;
