For the purposes of this Regulation, it should be provided that in Ireland the concept of ‘domicile’ replaces the concept of ‘nationality’ which is also the case in the United Kingdom, subject to this Regulation being applicable in the latter Member State in accordance with Article 4 of the Protocol on the position of the United Kingdom and Ireland annexed to the Treaty on European Union and the Treaty establishing the European Community.

The Commission considers that the UK applies disproportionate sanctions on those EU citizens who to buy goods in other Member States, excise duty paid, and then bring these products to the UK, either personally or by post, not for their “own use” but rather to sell the goods to family, neighbours or friends on a not-for-profit basis.
