This [INSTRUMENT] constitutes a development of the provisions of the Schengen acquis in which the United Kingdom does not take part, in accordance with Council Decision 2000/365/EC of 29 May 2000 concerning the request of the United Kingdom of Great Britain and Northern Ireland to take part in some of the provisions of the Schengen acquis*; the United Kingdom is therefore not taking part in its adoption and is not bound by it or subject to its application.

In an area in ICES divisions IVb, c limited by a point at 53°28'22"N, 0°09'24"E, on the coast of England, a straight line joining this point with 53°28'22"N, 0°22'24"E, the 6 mile boundary of the United Kingdom, and a straight line connecting a point at 51°54'06"N, 1°30'30"E, with a point on the coast of England at 51°55'48"N, 1°17'00"E, a minimum conservation reference size of 115 mm shall apply.

5. The application of this Regulation to the airport of Gibraltar is understood to be without prejudice to the respective legal positions of the Kingdom of Spain and the United Kingdom of Great Britain and Northern Ireland with regard to the dispute over sovereignty over the territory in which the airport is situated.

L’application du présent règlement à l’aéroport de Gibraltar s’entend sans préjudice des positions juridiques respectives du Royaume d’Espagne et du Royaume-Uni de Grande-Bretagne et d’Irlande du Nord au sujet du différend relatif à la souveraineté sur le territoire où cet aéroport est situé.

‘ “Territory” means, for the United States, the land areas (mainland and islands), internal waters and territorial sea under its sovereignty or jurisdiction, and, for the European Union and its Member States, the land areas (mainland and islands), internal waters and territorial sea in which the Agreement on the European Economic Area is applied and under the conditions laid down in that agreement and any successor instrument, with the exception of the land areas and internal waters under the sovereignty or jurisdiction of the Principality of Liechtenstein; application of this Agreement to Gibraltar airport is understood to be without prejudice to the respective legal positions of the Kingdom of Spain and the United Kingdom with regard to the dispute over sovereignty over the territory in which the airport is situated, and to the continuing suspension of Gibraltar Airport from European Union aviation measures existing as at 18 September 2006 as between Member States, in accordance with the Ministerial statement on Gibraltar Airport agreed in Córdoba on 18 September 2006; and’.
