This [INSTRUMENT] constitutes a development of the provisions of the Schengen acquis in which the United Kingdom does not take part, in accordance with Council Decision 2000/365/EC of 29 May 2000 concerning the request of the United Kingdom of Great Britain and Northern Ireland to take part in some of the provisions of the Schengen acquis*; the United Kingdom is therefore not taking part in its adoption and is not bound by it or subject to its application.

Dès lors que la Communauté notifie à l'Agence, conformément à la section 1, point C), du protocole 1 au présent accord, que les quantités de matières nucléaires présentes sur les territoires du Royaume-Uni relevant du protocole I aux fins d'activités nucléaires pacifiques dépassent les limites visées à la section 1, point A)1), du protocole 1 au présent accord ou que la décision de construire ou d'autoriser la construction d'une installation, telle que définie dans les définitions, dans les territoires du Royaume-Uni relevant du protocole I, visée à la section 1, point A)2), du protocole 1 au présent accord, selon ce qui survient en premier, un protocole relatif aux procédures de coopération aux fins de l'application des garanties prévues dans l'accord est conclu entre le Royaume-Uni, la Communauté et l'Agence.
At such time as the Community notifies the Agency in accordance with Section 1(C) of Protocol 1 of this Agreement that there is nuclear material in peaceful nuclear activities in United Kingdom Protocol I territories in quantities that exceed the limits referred to in Section 1(A)(1) of Protocol 1 of this Agreement or that the decision has been taken to construct or authorize construction of a facility, as defined in the Definitions, in United Kingdom Protocol I territories, as referred to in Section 1(A)(2) of Protocol 1 of this Agreement, whichever occurs first, a Protocol for procedures for cooperation in the application of the safeguards provided for under the Agreement shall be agreed upon between the United Kingdom, the Community and the Agency.

Stresses that the Director-General of DG AGRI entered a reservation in the DG’s 2013 annual activity report as regards granting recognition to producer groups in Austria, the Netherlands, Poland and the UK; notes that it is estimated that up to 25 % of total expenditure might be at risk; considers it vital in this connection to verify whether the possible disqualification of a PO is due to incorrect recognition procedures on the part of the national authorities, which should lead to those authorities being disqualified on the grounds that they are failing to comply with the regime’s objectives, or whether it is due to a lack of clarity in the rules, in which case the rules should be clarified;

Points out the weaknesses found by the Court of Auditors in its Special Report No 2/2014 entitled ''Are Preferential Trade Arrangements appropriately managed?" in the control strategy and risk management in Germany, France and the United Kingdom leading to potential losses to the Union budget; notes that these weaknesses were confirmed by the amount of revenue potentially lost in these three Member States; observes that by extrapolating the errors found in its sample of 2009, the Court of Auditors has estimated the amount of duties at stake in these Member States because of time-barring to be EUR 655 million; notes that this represents around 6 % of the gross amount of import duties collected in the five selected Member States that year, made up of EUR 167 million in respect of Germany, EUR 176 million in respect of France and EUR 312 million in respect of the United Kingdom;

In order that those wines may continue to be prepared by the customary methods whereby they acquire their characteristic properties, provision should be made for a derogation from abovementioned Annex V(B)(1) in their case.
