Acknowledges the significant progress accomplished by Romania in relation to child protection, but reiterates its concern at the high number of abandoned children each year, many of them in paediatric clinics, invisible in legal terms and therefore extremely vulnerable to trafficking in human beings; urges the Romanian authorities to take the necessary measures to guarantee systematic registration of births; considers that all abandoned children have the right to the opportunity of having a family and calls the Romanian authorities to authorise international adoptions if necessary, in accordance with The Hague Convention on Protection of Children and Cooperation in Respect of Intercountry Adoption; reiterates its repeated calls for the cases of the 1092 abandoned children for whom an application for adoption had been lodged to be resolved in the best interests of the child and taking into account the established relations between these children and their prospective adoptive families;

Notes with satisfaction the improvements made by the Romanian authorities in the area of the protection of children and urges the Romanian Government to settle the cases of applications for international adoption made during the moratorium of June 2001, ensuring that all cases are examined in the light of the UN Convention on the Rights of the Child and the Romanian Law on the Legal Status of Adoption, with the goal of allowing inter-country adoptions to take place, where justified and appropriate, in those special cases;

The cases which you referred to in your question, Mr Gil-Robles, and which had already been initiated but where a decision was still pending when the moratorium was imposed are being examined by the Romanian Government on a case-by-case basis, and if it is quite clear that there are no problems with the adoption, the Romanian Government has the option of suspending the moratorium in these individual cases.

Concerning the information published today in a French newspaper article on the action taken by the Commission in respect of abandoned Romanian children, the Commission would like to add the following details: In response to a European Parliament resolution in May and various appeals on the subject of the conditions in which abandoned Romanian children were being lodged, the Commission, which has no office in Romania, asked the NGOs to make enquiries. At the end of August it sent a team to Romania. The Prime Minister, Mr Roman, wrote to President Delors on 3 September and the latter replied on 26 September, following examination of the information brought back by the team and consultation with the NGOs. On 27 September a Romanian delegation investigated the start-up conditions for the operation due to be launched there by a further combined Commission and NGO team which will be in Romania from 15 to 20 October.
