In a situation involving a conflict of laws, where the law applicable to the sales or service contract is determined in accordance with Article 6(1) and (2) of Regulation (EC) No 593/2008 of the European Parliament and of the Council of 17 June 2008 on the law applicable to contractual obligations (Rome I) , the solution imposed by the ADR entity should not result in the consumer being deprived of the protection afforded to him by the provisions that cannot be derogated from by agreement by virtue of the law of the Member State in which the consumer is habitually resident.

Comme il ne s'agit pas d'une modification de fond par rapport à l'article 3, paragraphe 3, de la convention de 1980 sur la loi applicable aux obligations contractuelles (convention de Rome), le texte du présent règlement devrait être aligné dans la mesure du possible sur l'article 14 du règlement (CE) no 864/2007.
Whereas no substantial change is intended as compared with Article 3(3) of the 1980 Convention on the Law Applicable to Contractual Obligations (the Rome Convention), the wording of this Regulation is aligned as far as possible with Article 14 of Regulation (EC) No 864/2007.
