In this respect, the applicant argues that if the Commission, before 8 August 2008 (the date on which the applicant approved an amendment to the restructuring plan concerning the preservation of the silos), had answered the applicant’s written question about the preservation of certain structures, if it had amended and supplemented Regulation No 968/2006 (1) and if, having received the communication relating to the alteration of the restructuring programme, it had informed the applicant of the alleged irregularity concerning the preservation of the silos, or if it had written to all the Member States informing them of its interpretation of the unclear provisions of the relevant legislation, the financial correction at issue would not have been made and the contested decision would not have been adopted.

Après avoir examiné les observations des autorités italiennes et de SACE sur la décision d'ouverture de la procédure, la Commission a constaté que les informations transmises restaient insuffisantes pour permettre une appréciation exhaustive des mesures en tant qu'aides éventuelles à la restructuration; en février 2012, elle a invité les autorités italiennes à fournir des informations complémentaires sur la compatibilité éventuelle des mesures et à présenter un véritable plan de restructuration, en conformité avec la communication sur les mesures de restructuration.
As following Italy's and SACE's comments to the opening decision the Commission found the submitted information still insufficient to allow for a complete assessment of the measures as potential restructuring aid, in February 2012 the Commission offered Italy the possibility to provide additional elements on potential compatibility ground, by submitting a fully-fledged restructuring plan, in line with the Restructuring Communication.

2. 2. This Regulation is without prejudice to any obligation on a Member State to notify individual grants of aid under other State aid instruments, and in particular the obligation to notify, or to inform the Commission of, aid to an enterprise receiving restructuring aid within the meaning of the Community guidelines on State aid for rescuing and restructuring firms in difficulty(10) and the obligation to notify regional aid for large investment projects under the applicable multisectoral Framework".
