Deplores the content of the political agreement of 6 October 2015 within the Council, which falls short of the Commission’s legislative proposal of March 2015 amending Directive 2011/16/EU as regards mandatory automatic exchange of information in the field of taxation; stresses that the latter provided, on top of a common framework for the registration and automatic exchange of information on rulings, provisions allowing the Commission to effectively monitor its implementation by Member States and ensure that rulings do not have a negative impact on the internal market; stresses that the adoption of the Council’s position would prevent drawing all benefits from the automatic exchange of rulings, in particular in terms of effective implementation, and calls on the Council, therefore, to stick to the Commission’s proposal and take due account of the Parliament’s opinion thereon, in particular as regards the scope of the directive (all tax rulings instead of cross-border only), the retroactivity period (all tax rulings still valid should be exchanged) and the information provided to the Commission, which should have access to the tax rulings;

12. déplore que la réponse de la Commission au scandale "Lux Leaks" soit insuffisante; demande à la Commission d'inclure au minimum dans son paquet fiscal une obligation de rendre les rescrits fiscaux publics, afin de garantir la transparence et le contrôle, ainsi que les rapports par pays basés sur les règles relatives aux banques de la directive CRD IV; regrette que la Commission affaiblisse encore la protection des lanceurs d'alerte et des employés par le biais de la directive sur le secret des affaires; prie instamment la Commission et les États membres de veiller à ce que les lanceurs d'alerte soient protégés sur le plan juridique et matériel lorsque l'on peut raisonnablement estimer qu'ils protègent les intérêts publics;

Regrets that the response announced by the Commission to the ‘Lux Leaks’ scandal is insufficient; urges the Commission, as a minimum, to include in its tax package an obligation to make tax rulings public in order to ensure transparency and scrutiny, as well as country-to-country reporting based on the CRD IV rules for banks; regrets that the Commission is further weakening the protection of whistle-blowers and employees through the Trade Secrets Directive; urges the Commission and Member States to ensure that whistle-blowers are legally and materially protected when they can reasonably be assumed to be protecting public interests;
