En l’espèce, s’il résulte des motifs et des conclusions ci-dessus énoncés que la requérante est la partie qui succombe et que la Commission a conclu à sa condamnation aux dépens, il en ressort également que, alors que la requérante avait demandé à plusieurs reprises la communication d’informations la concernant, relatives à ses épreuves écrites b) et c), en suivant la procédure établie au titre D, point 4, de l’avis de concours, et avait reçu plusieurs communications de l’EPSO d’après lesquelles la documentation demandée y était annexée, l’EPSO n’a fait droit à la demande de communication d’informations que le 16 juin 2010, à savoir alors que la requérante avait déjà introduit sa requête.
In the present case, although it is clear from the pleas and forms of order set out above that the applicant is the unsuccessful party and that the Commission has applied for her to be ordered to bear the costs, it is also apparent that although the applicant had asked on several occasions for information about her, concerning her written tests (b) and (c), following the procedure laid down in Section D.4 of the notice of competition, and had received several communications from EPSO stating that the documents requested were attached to them, EPSO did not grant the request for information until 16 June 2010, that is to say, when the applicant had already lodged her application.

13 Enfin, sur le quatrième moyen, tiré de la violation de l’article 73 du règlement n° 40/94, le Tribunal a notamment jugé, aux points 103 à 105 de l’arrêt attaqué, qu’il ne pouvait être reproché à la chambre de recours d’avoir fondé sa décision sur des motifs sur lesquels la requérante n’avait pas pu prendre position, car l’examinateur avait déjà considéré, dans sa décision, que «[l]e chiffre d’affaires de la requérante ne permet[tait] pas d’inférer que le consommateur reconn[aissait] les bonbons à leur emballage et leur associ[ait] une seule entreprise» et que, «[à] défaut de chiffres comparatifs d’entreprises concurrentes ou de données sur le marché dans son ensemble, il [était] impossible d’apprécier les chiffres d’affaires».
Finally, as to the fourth plea, alleging infringement of Article 73 of Regulation No 40/94, the Court of First Instance held, in particular, in paragraphs 103 to 105 of the judgment under appeal, that it cannot be alleged that the Board of Appeal based its decision on reasons or evidence on which the applicant had not had an opportunity to present its comments, since the examiner had already found, in his decision, that ‘the applicant’s turnover did not enable it to be inferred that the consumer recognised the sweets from their wrapper and associated them with a single undertaking’ and that ‘in the absence of comparable turnover figures for competitors or information on the market as a whole, it [was] impossible to assess the turnover figures’.
