Following on from the Council’s answer (H-0132/08 ) concerning the plight of Antonio Guerrero, Fernando González, Gerardo Hernández, Ramón Labañino, and René González, Cuban patriots who had sought to defend their country in the face of terrorist acts being fomented and mounted by US-based organisations in Miami, one point that needs to be clarified is whether the UN Working Group on Arbitrary Detention has ever commented on the issue of visas to the relatives of these five Cuban patriots imprisoned in the US.

Following the decision taken on 27 May 2005 by the UN Working Group on the five Cuban citizens being held in the USA – Antonio Guerrero, Fernando González, Gerardo Hernández, Ramón Labañino and René González – stating that 'the trial did not take place in a climate of objectivity and impartiality', the 11th Circuit Court of Appeals of Atlanta (USA) unanimously decided on 9 August 2005 to annul the judgment delivered in Miami and therefore to quash the convictions against the five Cuban nationals, and ordered a new trial to be held.
