Je tiens à être clair: mes remarques portent sur le fait que le projet de loi préconise une technique de rédaction appelée « l'incorporation par renvoi », et en particulier l'incorporation par renvoi dynamique, selon laquelle la mention « tel que modifié » serait insérée de temps en temps pour signaler qu'un changement apporté par une entité externe à des documents, ou à d'autres matériels, incorporés par renvoi serait automatiquement inclus dans la réglementation et aurait force de loi, et ce, sans l'intervention du Parlement.
Let me be clear that my focus and remarks are on the endorsement in the bill of a so-called drafting technique known as incorporation by reference, in particular open incorporation by reference, whereby the words “as it is amended from time to time” would be inserted to signal that a document that is incorporated by reference or other materials, when it is changed by external bodies, would automatically enter back into the regulation and continue as binding law without any further intervention by Parliament.
