Points out that interventions by the Court of Justice, the European Ombudsman and the European Data Protection Supervisor (EDPS), which basically take positions on individual cases, cannot replace legislative activity in terms of legal certainty and equality before the law; regrets that even when the Court of Justice has established a clear principle, as for example in the Turco case on legislative transparency, it is still not complied with; consequently repeats its call to institutions to abide by the Turco judgment on legal service opinions drafted in the framework of the legislative process; reaffirms that the legislator must address and overcome the problems highlighted by the Court of Justice jurisprudence and implement the right to access to documents fully and more extensively, in the spirit of the new Treaty modifications which clearly establish a fundamental right of access to documents;

Article 13 (2) (a) shall apply subject to the following exceptions and circumstances: 1 (a) A person employed in the territory of a Member State by an undertaking to which he is normally attached who is posted by that undertaking to the territory of another Member State to perform work there for that undertaking shall continue to be subject to the legislation of the first Member State, provided that the anticipated duration of that work does not exceed 12 months and that he is not sent to replace another person who has completed his term of posting;

e) Par dérogation à la disposition prévue à l'alinéa d), la disposition suivante est applicable aux affiliés à l'assurance pension allemande qui, au cours de la période allant du 1er janvier 1948 au 31 juillet 1963, ont résidé dans les territoires allemands sous administration néerlandaise: pour la prise en compte des périodes allemandes de remplacement (Ersatzzeiten) au sens de l'article 1251 paragraphe 2 de la loi allemande en matière d'assurance sociale (RVO) ou de dispositions correspondantes, le versement de cotisation à l'assurance néerlandaise au cours de cette période est assimilé à l'exercice d'un emploi ou d'une activité relevant de l'assurance obligatoire au sens de la législation allemande.
(e) By way of derogation from the provision laid down in subparagraph (d), the following provision shall apply to persons insured under the German pension insurance scheme who were residing in German territories under Netherlands administration during the period from 1 January 1948 to 31 July 1963; for the purpose of taking into account German substitute periods (Ersatzzeiten) within the meaning of Article 1251 (2) of the German social security law (RVO) or corresponding provisions, payment of contributions to Netherlands insurance schemes during that period shall be treated as equivalent to having been employed or having pursued an activity coming under compulsory insurance within the meaning of German legislation.
