Dans ces circonstances, contestées en première instance par la requérante comme étant constitutives d’une contradiction de motifs, le Tribunal de la fonction publique a considéré à titre liminaire, en se fondant sur l’arrêt Commission/Birkhoff, précité (points 58 et 59), que, compte tenu du caractère évolutif de la procédure précontentieuse, c’est la motivation figurant dans la décision de rejet de la réclamation qui devait être prise en considération pour l’examen de la légalité de l’acte initial faisant grief, cette motivation étant censée coïncider avec ce dernier acte.
In those circumstances, which were disputed by the applicant at first instance as being contradictory reasons, the Civil Service Tribunal considered, as a preliminary point, taking as a basis Commission v Birkhoff, cited above, paragraphs 58 and 59, that, in view of the evolving nature of the pre-litigation procedure, it is the statement of reasons contained in the decision rejecting the complaint which must be taken into account in the review of legality of the original act adversely affecting an official, since that statement of reasons is deemed to supplement that act.

Following the referendum held in Ireland on 12-13 June 2008, statements have been issued by the Commission President, EU Heads of Government and members of the European Council in a bid to ignore the resounding ‘no’ of the Irish people regarding the Lisbon Treaty and proceed with the ratification process, thereby disregarding not only the verdict delivered in Ireland, but also the outcome of the referendums held in France and the Netherlands in 2005 rejecting the European Constitution, and this at a time when growing anti-EU sentiment is spreading to other Member States, which have been deprived by their governments of the right to a referendum on the Lisbon Treaty.

The CFI, by failing to order the disclosure of the evidence requested, has infringed the fundamental right to a fair trial to which the applicant is entitled, by refusing to assess evidence which is essential to the applicant's case thereby infringing its rights of defence, since its application was dismissed on the ground that it had not proved what it specifically sought to establish with the evidence which was not produced: if not the Commission's final position with respect to the complaint of 1994 against the tax rules of 1993 (including a tax credit), which are measures which are essentially the same as the contested measure, which rejected that complaint, then at least the attitude of the Commission which would constitute an exceptional circumstance in so far as its conduct gave rise to a legitimate expectation that the 1993 tax measures were lawful, which led to the adoption of the contested tax measure in 1996.
