Cet enregistrement fait suite à l'annulation, le 10 mai 2017, par le Tribunal de l'Union européenne, de la décision initiale de la Commission du 10 septembre 2014 rejetant la demande d'enregistrement de l'initiative «Stop TTIP».
This registration follows an initial Commission Decision to refuse to register the 'Stop TTIP' Initiative on 10 September 2014, which was annulled by the General Court of the European Union on 10 May 2017.

In such a situation, it is indeed the legality of the initial act adversely affecting the applicant that must be examined, taking into consideration the reasons set out in the decision rejecting the complaint, as that reasoning is deemed to coincide with that act (see, to that effect, judgment in Commission v Birkhoff, Case T‑377/08 P, EU:T:2009:485, paragraphs 58 and 59 and the case-law cited therein).

In those circumstances, which were disputed by the applicant at first instance as being contradictory reasons, the Civil Service Tribunal considered, as a preliminary point, taking as a basis Commission v Birkhoff, cited above, paragraphs 58 and 59, that, in view of the evolving nature of the pre-litigation procedure, it is the statement of reasons contained in the decision rejecting the complaint which must be taken into account in the review of legality of the original act adversely affecting an official, since that statement of reasons is deemed to supplement that act.
