S'il est constaté qu'un agriculteur n'a pas respecté sur son exploitation, au cours des trois années qui ont suivi le paiement de l'aide à la restructuration ou à la reconversion au titre du programme d'aide ou au cours de l'année qui a suivi le paiement de l'aide à la vendange en vert au titre du programme d'aide, les exigences réglementaires en matière de gestion et les bonnes conditions agricoles et environnementales visées aux articles 3 à 7 du règlement (CE) no 1782/2003, et que le manquement est la conséquence d'une action ou d'une omission directement imputable à l'agriculteur, le paiement est réduit ou annulé, totalement ou partiellement, selon la gravité, l'étendue, la persistance et la répétition du manquement, et il est exigé, le cas échéant, de l'agriculteur qu'il rembourse les montants perçus conformément aux conditions établies dans lesdites dispositions.
Where farmers are found not to have complied on their holding, at any time during three years from payment under the support programmes for restructuring and conversion or at any time during one year from payment under the support programmes for green harvesting, with the statutory management requirements and the good agricultural and environmental condition referred to in Articles 3 to 7 of Regulation (EC) No 1782/2003, the amount of the payment shall, where non-compliance is the result of an action or omission directly imputable to the farmer, be reduced or cancelled, partially or wholly depending on the severity, extent, permanence and repetition of the non-compliance, and the farmer shall, where applicable, be ordered to reimburse it in accordance with the conditions set out in those provisions.

The first subparagraph shall apply mutatis mutandis to beneficiaries who are found not to have complied with the rules on cross-compliance, at any time during three years from 1 January of the year following the calendar year in which the first payment was granted under the support programmes for restructuring and conversion or at any time during one year from 1 January of the year following the calendar year in which the payment was granted under the support programmes for green harvesting referred to in Regulation (EU) No 1308/2013('the years concerned').
