Si l'emprisonnement est maintenu comme possibilité, nous pourrions envisager une disposition comme celle que recommandait Mme Arsoniadis Stein : « Nonobstant toute disposition contraire de cette loi, lorsqu'une peine d'emprisonnement est requise, l'accusé est présumé innocent tant que la Couronne n'a pas établi sa culpabilité au-delà de tout doute raisonnable».
Alternatively, we could look at some other wording and, as Ms.Arsoniadis Stein mentioned, we could have something along the lines of ``Notwithstanding any provision of this act, a penalty of imprisonment shall not be imposed unless the guilt of the accused is established beyond a reasonable doubt'. '
