(3) Undisclosed information communicated under this Agreement may be disseminated by the receiving Party to persons employed by the receiving Party, including its contractors, and other concerned departments of the Party authorised for the specific purposes of the joint research underway, on a-need-to-know basis and provided that any undisclosed information so disseminated shall be protected in accordance with this Annex and to the extent provided by each Party’s laws and regulations, and shall be readily recognisable as such, as set out above.

If an applicant withdraws, or has withdrawn, its application, the Authority, the Commission and the Member States shall respect the confidentiality of commercial and industrial information, including research and development information, as well as information the confidentiality of which is the subject of disagreement between the Commission and the applicant.

Takes note of the Commission's proposal to develop the ESRP as part of the Seventh EU Research Framework Programme; underlines that the ESRP should respect the particular nature of security research, taking into account specific elements such as rules governing intellectual property rights, treatment of classified information, protection of secure information and technology transfer; stresses that the activities of the ESRP should be based on the codecision procedure;

10. invite la Commission à tirer profit de l'expérience acquise lors du premier appel à propositions dans le cadre de l'action préparatoire afin de confirmer les domaines de priorité; est d'avis qu'une attention accrue devrait être accordée à la recherche concernant l'acceptation publique de la recherche dans le domaine de la sécurité et au traitement des données confidentielles afin de permettre un échange plus étendu de ces données entre les États membres;

Calls on the Commission to build on the experience gained in the first call for proposals as part of the preparatory action in order to confirm the priority areas; believes greater attention should be paid to research into public acceptance of security research and to handling of classified data in order to allow more extensive exchange of such data between Member States;

Les informations confidentielles communiquées au titre du présent accord peuvent être diffusées par la partie destinataire aux personnes qui la composent ou qu'elle emploie ainsi qu'à ses autres ministères ou agences concernés autorisés aux fins spécifiques des activités de recherche communes en cours, à condition que la diffusion desdites informations fasse l'objet d'un accord de confidentialité et que leur caractère confidentiel soit immédiatement reconnaissable conformément aux dispositions visées ci-dessus.
